crTMMARY: In accordance with RCW 36.81, we have reviewed the first half mile of Zander Drive for inclusion
j the County Road System as a public road in accordance with the request of the petitioning freeholders. The
petition is valid and was submitted with the necessary filing fee, the applicants have performed the necessary work
on the roadway to conform with County Standards, and Assignment of Savings and /or deposits have been made to
provide for work remaining, including, signing and road striping.

ORDINANCE NO. 97 -070
2 IN THE MATTER OF ACCEPTING
3 A PORTION OF ZANDER DRIVE AS A PUBLIC ROAD
4 WHEREAS, A private road commonly known as Zander Drive, was privately constructed
5 to County Public Road Standards through the Short Plat process, and
6 WHEREAS, Chapter 36.81 RCW allows the County to accept roadways into the County
7 Road System and
8 WHEREAS, interested land owners have submitted a valid petition to establish a portion
9 of Zander Drive as a public road and
10 WHEREAS, on December 9, 1997 a public hearing was held to consider the land
11 owners's request to review the Report from the County Engineer and to receive public testimony
12 in this regard.
1.3 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the half
14 mile portion of Zander Drive located immediately south of the Smith Road being within the
15 attached legal description (Exhibit "A "), within Section 34, Township 39 North, Range 3 East
16 W.M. be hereby established as a public road. Subject to the following conditions:
17 1. Receipt of Executed Deeds for Right -Of -Way
18 ADOPTED this 9 day of Decembgr1997.

Legal Description
For A Proposed Public Road
Named Zander Drive
Said road comprised of a 60 foot wide right of way for all lawful road purposes, together with
an area for a turnaround at the southerly end. Said right of way more particularly described as
follows:
The Easterly 30 feet of the West one half of the East one half of the Northwest one quarter of
Section 34, Township 39 North, Range 3 East of W.M. Together with an area for a turnaround
being the Westerly 20 feet of the Easterly 50 feet of the Southerly 100 feet of said West half,
Whatcom County, Washington.
AND The Westerly 30 feet of the East one half of the East one half of the Northwest one
quarter of Section 34, Township 39 North, Range 3 East of W.M.. Together with an area for
a turnaround being the Easterly 10 feet of the Westerly 40 feet of the Southerly 100 feet of said
East half. Whatcom County, Washington.
