The request is to extend the Interim Zoning for the fee lands within the Mt. Baker National Forest and Lummi Reservation
for a -period of one year and adopt a work program for the adoption of permanent zoning for these two areas. The Interim
zoning for the Mt. Baker and Lummi Reservation fee lands was first adopted on July .6, 1972 and has been extended
annually for 25 years. The Planning Commission and Planning staff are determined to complete land use plans for these
two areas and recommend permanent zoning for the fee lands by November, 1998. The Planning Commission has met
once with the Lummi Nation Planning Commission to begin discussion of joint planning for the Lummi Nation fee lands.
Additional joint meetings will be scheduled this winter, with public hearings in the Spring. Permanent zoning for the Mt.
Baker fee lands must be based .on adopted Comprehensive Plan designations. Land Use designations for the Mt. Baker
fee lands in the Mt. Baker forest will be proposed in the 1998 Comprehensive Plan amendment, scheduled for County
Council adoption in November 1998.
ORIGINATOR'S RECOMMENDED ACTION: The Director of Planning and Development Services recommends Counci'
adopt the attached Ordinance and work program.

I ORDINANCE NO. 97 -068
2 AN ORDINANCE EXTENDING THE INTERIM ZONING ORDINANCE,
3 CHAPTER 2.24A, ON A ONE YEAR INTERIM BASIS FOR THOSE FEE LANDS
4 WITHIN THE LUMIVII RESERVATION AND WITHIN THE MT. BAKER
5 SNOQUALMIE NATIONAL FOREST
6 WHEREAS, pursuant to RCW 36.70.790, Whatcom County adopted an Interim Zoning Ordinance
7 on July 6, 1972; and
8 WHEREAS, the Interim Zoning Ordinance, Chapter 2.24A of the Whatcom County Code, has been
9 repeatedly extended for 25 years and is scheduled to expire on January 15, 1998; and
10 WHEREAS, areas applicable under Chapter 2.24A include fee lands within the Lummi
11 Reservation and private property exclaves within the Mt. Baker National Forest; and
12 WHEREAS, the County has established permanent Title 20 zoning in eleven geographic subareas
13 and is ready to proceed with exclaves in the National Forest.
14 WHEREAS, Whatcom County desires to cooperate with the Lummi Nation in achieving
5 compatible zoning on a permanent basis within the boundaries of the Reservation, and
16 WHEREAS, the County is not prepared to adopt permanent amendments to the County's zoning
17 regulations at this time, and will require up to one year to develop permanent zoning for exclaves within
18 the National Forest and to make significant progress with the Lummi Nation on cooperative planning
19 efforts; and
20 WHEREAS, RCW 36.70.795 provides for the adoption of interim official controls for effective
21 periods of up to one year if a work plan is developed for related plans or studies, and allows the adoption
22 of interim official controls prior to a public hearing if such hearing is held within 60 days of its adoption;
23 and
24
25 WHEREAS, a Determination of Non - Significance was issued by the Deputy SEPA; and
26 WHEREAS, based on the above findings, the Whatcom County Council declares that an interim
27 ordinance is necessary for preservation of the public peace, health, safety and welfare.
28 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that:
29 Section 1. The Interim Zoning Ordinance, Chapter 2.24A of the Whatcom County Code, is
30 hereby extended to December 9, 1998.
,11 Section 2. The Whatcom County Council shall hold a public hearing concerning such interim
32 development regulations within sixty (60) days from adoption of this Ordinance.

Section 3. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance
shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so
declared to be invalid.
