ORDINANCE NO. 97 -060
An Ordinance Amending Whatcom County Code, Chapter 9.04.030,
Repealing Prohibition of Public Card Rooms in Unincorporated
Areas of Whatcom County.
WHEREAS, commercial gaming activity has expanded significantly
in Whatcom County following passage of the Indian Gaming Regulatory
Act by the U.S. Congress; and
WHEREAS, a portion of the expanded gaming activity is
occurring in unincorporated areas of the county; and
WHEREAS, most commercial gaming activity, including that
conducted in public card rooms, is regulated by the Gambling
Commission of the State of Washington; and
WHEREAS, from a practical standpoint, additional gaming
activity attributable to public card rooms is most likely to occur in
established, regulated facilities where other forms of gaming already
occur; and
WHEREAS, in light of the considerations listed above, the
public policy reasons for prohibiting public card rooms have
diminished,
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council
that: the prohibition against public card rooms and public card games
contained in Whatcom County Code, Chapter 9.04.030, an ordinance
dated September 20, 1976, is repealed, and the ordinance is hereby
amended, as detailed in Exhibit "All attached to this Ordinance.
BE IT FURTHER ORDAINED that if any portion of this Ordinance
is found to be unlawful, all remaining portions shall remain in
effect.

Whatcom County Code, Chapter 9.04.030 is amended as follows:
Pursuant to the authority contained in RCW 9.46.295, the following activities are
absolutely prohibited throughout the unincorporated areas of Whatcom County:
13^ Every social card game use as or in connection with, a commercial stimulant.
