SUMMARY: RCW 86.15.025 authorizes the Division of the County-wide Flood Control Zone District into
)arately designated sub - zones, and authorizes the establishment of such sub -zones by Resolution of the Council.
Kesidents of the area have requested the creation of a Flood Control sub -zone district and the Flood Control Zone
District Advisory Committee has officially endorsed formation of said sub -zone.

2 ESTABLISHING A FLOOD CONTROL ZONE DISTRICT SUB -ZONE
3 WHEREAS, RCW 86.15.025 authorizes the division of the County -wide Flood Control
4 Zone District into separately designated sub - zones; and
5 WHEREAS, RCW 86.15.025 authorizes the establishment of such sub -zones by
6 resolution of the Council and further states that RCW 86.15.020 and 86.15.030 do not apply to
7 the establishment of such sub - zones; and
8 WHEREAS, the draft Comprehensive Flood Hazard Management Plan for the Lower
9 Nooksack River recommends the formation of sub -zones in certain reaches and flood areas, and

WHEREAS, residents of the Acme /VanZandt area have requested the formation of such
a sub -zone; and
WHEREAS, the Flood Control Zone District Advisory Committee has officially endorsed
formation of said sub -zone; and
WHEREAS, a map and legal description of said Acme /VanZandt sub -zone is included
in this Ordinance as Attached Exhibit "A ".
NOW, THEREFORE BE IT ORDAINED, by the County Council that the
Acme /VanZandt sub -zone of the Whatcom County Flood Control Zone District is hereby
established.

LEGAL DESCRIPTION
A subzone district comprised of all or part of sections 7, 8, 9, 10, 15, 16, 17, 18, 19, 20, 21, 22,
27, 28, 29, 30, 31, 32, 33, 34 and 35 of Township 38 North, Range 5 East of W.M.
AND all or part of sections 12, 13, 14, 23, 24, 25, 26, 35 and 36 of Township 38 North, Range
4 East of W.M.
AND all or part of sections 1, 2, 11, 12, 13 of Township 37 North, Range 4 East of W.M.
AND all or part of sections 2., 3, 4, 5, 6, 7, 8, 9, 10, 15, 16, 17, 18, 21, 22, 23, 24, 26 and 27
of Township 37 North, Range 5 East of W.M.
The perimeter of said subzone more particularly described as follows:
commencing at the Southwest corner of section 13, said T37N, R4E, and being the true point of
beginning; thence North one mile, to the Southeast corner of section 11, T37N, R4E; thence West
3/4 of a mile, to the Southwest corner of the Southeast one quarter of the Southwest one quarter
of said section 11; thence North one mile to the Southwest corner of the Southeast quarter of the
Southwest quarter of section 2, T37N, R4E; thence East 1/4 mile, to the South quarter corner of
said section 2; thence North 3 miles to the South quarter corner of section 23, T38N, R4E; thence
West one -half mile to the Southwest corner of said section 23; thence North 2 miles to the
