Emergency Ordinance No. 97 -025, May 20, 1997 adopted zoning overlay maps to implement the Short Term Planning
areas on an emergency basis valid for 60 days. RCW 36.70.795 requires that the Council hold a public hearing within at
60 days of adopting an interim zoning map. The interim maps may be effective for not longer than six months, but
n.uy be effective for up to one year if a work plan is developed for related studies providing for such a longer period.
ORIGINATOR'S RECOMMENDED ACTION: The Director of Planning and Development Services recommends
Council conduct a public hearing and approve an ordinance adopting the Interim zoning overlay maps to implement the
Short Term Planning areas that were originally adopted by Emergency Ordinance No. 97 -025.

ORDINANCE NO. 97 -037
AN EMERGENCY ORDINANCE ADOPTING ZONING OVERLAY MAPS TO IMPLEMENT THE
SHORT TERM PLANNING AREAS DESIGNATED IN THE OFFICIAL WHATCOM COUNTY
COMPREHENSIVE PLAN ON AN INTERIM BASIS.
WHEREAS, the 1990 State Growth Management Act as amended requires the
County to adopt a comprehensive plan and development regulations that are consistent
with and implement the comprehensive plan on or before July 1, 1994, with a six -month
extension on the adoption of development regulations allowed; and
WHEREAS, Whatcom County adopted a Comprehensive Plan on May 20, 1997
following a lengthy public process; and
WHEREAS, in order to find compliance with the Growth Management Act, interim
amendments to the Official Whatcom County Zoning Map, implementing new land use
direction proposed in the Comprehensive Plan are necessary, and should be adopted
following adoption of the Comprehensive Plan, and
WHEREAS, Whatcom County adopted interim Short Term Planning Area zoning
overlay maps (attached as Exhibit A) under Emergency Ordinance No. 97 -025 which
became law on May 22, 1997; and
WHEREAS, In accordance with Section 2.40 of the Whatcom County Charter, the
provisions of the Emergency Ordinance expire on July 23, 1997, the sixty -first day
following the date on which the ordinance became law; and
WHEREAS, the County is not prepared to adopt permanent amendments to the
County's development regulations at this time, and will require up to six months for
adequate analysis and public review to occur; and
WHEREAS, an error in mapping the County Council's recommendations resulted in
omitting from the Short Term Planning Area a parcel of approximately 58 acres, south of
Arnie Road, that meets the criteria for establishing Short Term Planning Areas as indicated
on Exhibit B, Revised Map #28 -H; and
WHEREAS, the County has prepared an Interim Ordinance to extend the Emergency
Ordinance, as revised, for up to six months; and

WHEREAS, SEPA requirements have been met by the Environmental Impact
Statements and associated documentation prepared in conjunction with adopting the
Comprehensive Plan.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that:
Section 1. To preserve the integrity of the process and directives mandated by
the Growth Management Act and pursuant to RCW 36.70A.040, it is hereby ordained that
the Short Term Planning Areas as presented in Exhibit A, attached, the adopted
Comprehensive Plan Appendix E, Map #s 28 -A, 28 -B, 28 -C, 28 -D, 28 -F, 28 -G, 28H, and
28 -1) with the revision presented in Exhibit B, Revised Map #28 -H, be adopted on an
emergency basis for sixty days from adoption of this Ordinance or until the effective date
of an Interim Ordinance adopting these Short Term Planning Areas.
Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions
of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any
part thereof other than the part so declared to be invalid.
