SUBJECT: AN ORDINANCE REPEALING THE INTERIM ZONING ORDINANCE, CHAPTER 2.24A, AND
ADOPTING TITLE 20 ZONING ON A SIX MONTH INTERIM BASIS FOR THOSE AREAS
OTHERWISE REGULATED BY CHAPTER 2.24A INCLUDING THE LUNMH RESERVATION
AND PRIVATE IN HOLDINGS WITHIN THE MT. BAKER SNOQUALMIE NATIONAL
FOREST

This action would streamline the regulatory process and avoid some unnecessary complexity. Adopting this as a
permanent control is not proposed because this would require, at a minimum, Planning Commission work sessions and
public hearings, more in -depth SEPA review, and joint planning efforts with the Lummi Nation. The action substitutes
Chapter 2.24A zoning designations with Title 20 zoning designations on an interim basis and repeals Chapter 2.24A in
its entirety.
ORIGINATOR'S RECOMMENDED ACTION: The Director of Planning & Development Services recommends the
Council adopt the proposed ordinance.

ORDINANCE NO. 97 -033
AN ORDINANCE EXTENDING THE INTERIM ZONING ORDINANCE,
CHAPTER 2.24A, ON A SIX MONTH INTERIM BASIS FOR THOSE FEE LANDS
WITHIN THE LUMMI RESERVATION AND WITHIN THE MT. BAKER -
SNOQUALMIE NATIONAL FOREST
WHEREAS, pursuant to RCW 36.70.790, Whatcom County adopted an Interim Zoning Ordinance
on July 6, 1972; and
WHEREAS, the Interim Zoning Ordinance, Chapter 2.24A of the Whatcom County Code, has
been repeatedly extended for 25 years and is scheduled to expire on July 15, 1997; and
WHEREAS, areas applicable under Chapter 2.24A include fee lands within the Lummi
Reservation and private property exclaves within the Mt. Baker National Forest; and
WHEREAS, the County has established permanent Title 20 zoning in eleven geographic subareas
and is ready to proceed with exclaves in the National Forest.
WHEREAS, Whatcom County desires to cooperate with the Lummi Nation in achieving
compatible zoning on a permanent basis within the boundaries of the Reservation, and
WHEREAS, the County is not prepared to adopt permanent amendments to the County's zoning
regulations at this time, and will require a minimum of six months to develop permanent zoning for
exclaves within the National Forest and to make significant progress with the Lummi Nation on
cooperative planning efforts; and
WHEREAS, RCW 36.70.795 provides for the adoption of interim official controls for effective
periods of up to six months, and allows the adoption of interim official controls prior to a public hearing
if such hearing is held within 60 days of its adoption; and
WHEREAS, a Determination of Non - Significance was issued by the Deputy SEPA; and
WHEREAS, based on the above findings, the Whatcom County Council declares that an interim
ordinance is necessary for preservation of the public peace, health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that:
Section 1. The Interim Zoning Ordinance, Chapter 2.24A of the' Whatcom County Code, is
hereby extended to January 15, 1998.
Section 2. The Whatcom County Council shall hold a public hearing concerning such interim
development regulations within sixty (60) days from adoption of this Ordinance.

Section 3. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance
shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so
declared to be invalid.
