SUMMARY STATEMENT:
This resolution proposes an extension of FCZD flood assessments
for the Sumas /Nooksack/Everson Sub -Zone for the year 2000, as
recommended by the Advisory Committees for the FCZD and the sub-
zone.

17 WHATCOM COUNTY FLOOD CONTROL SUB -ZONE FUNDING MECHANISM FOR
18 SUMAS/NOOKSACK/EVERSON SUB -ZONE

20 WHEREAS, the WCFCZD was duly created by Whatcom County Ordinance 91 -076 to
21 provide an organization and structure to address flood damage reduction in Whatcom County;
22 and,
23
24 WHEREAS, Resolution No. 98 -078 of the Whatcom County Council addressed the
25 relationship between the District and the County pertaining to the staffing of work needed to be
26 performed and the administrative procedures in order to fulfill the purposes of the District, and
27
28 WHEREAS, Ordinance No. 98 -065 amended the funding mechanism for the activities of
29 the Sumas/Nooksack/Everson Sub -Zone of the Flood Control Zone District and established a
30 service charge through December 31, 1999,

32 WHEREAS, the advisory bodies for the sub -zone and for the FCZD recommend
33. continuation of the current funding mechanism;

35 NOW, THEREFORE, BE IT RESOLVED, by the Whatcom County Flood Control Zone
36 District Board of Supervisors, that all parcels within the unincorporated and incorporated areas of
37 the FCZD Sumas/Nooksack/Everson Sub -Zone shall pay a service charge per parcel of 100 per-
38 cent of the County -wide Flood Zone assessment for all parcels within the 100 -year flood. plain
39 and/or within 200 -yards of the ordinary high water mark of the Nooksack River and 15 percent of
40 the County -wide Flood Zone assessment for all parcels out of the 100 -year flood plain and
41 greater than 200 -yards from the ordinary high water mark of the Nooksack River, with a
42 minimum assessment of $5.00, with the exception of the following exempt parcels:

a. All parcels owned by the Federal Government
b. All parcels classified as Indian Lands held in trust.
c. All parcels exclusively classified as mineral rights.
d. All parcels owned by the State, classified as "bedlands or tidelands"
e. All parcels with an assessed value less than or equal to $2,500.
BE IT FURTHER RESOLVED by the WCFCZD Board of Supervisors that the
Sumas/Nooksack/Everson Sub -Zone service charges in the same amount as stated hereinabove
be extended and imposed for the years 2000, 2001 and 2002, unless further amended.
BE IT FURTHER RESOLVED that the timing and method of collection for the
assessments hereinabove authorized, together with penalties, interest, and delinquent service
charges, shall be the same as provided for FCZD County -wide assessments in Sections 3 through
14 of Resolution No. 98 -078, as adopted by the Whatcom County Flood Control Zone District
Board of Supervisors on December 8, 1998, or as hereafter amended.
