SUMIVIARYSTATEMENT.
This resolution proposes an extension of FCZD flood assessments
for the Lynden /Everson Sub -Zone for the year 2000, as recommended
by the Advisory Committees for the FCZD and the sub -zone.

of the County -wide Flood Control Zone District .
hereinafter referred to as the
"atcom County Flood Control Zone District ( WCFCZD)
RESOLUTION NO. 99 -055
A RESOLUTION EXTENDING CURRENT
WHATCOM COUNTY FLOOD CONTROL SUB -ZONE FUNDING MECHANISM FOR
LYNDEN/EVERSON SUB -ZONE
WHEREAS, the WCFCZD was duly created by Whatcom County Ordinance 91 -076 to
provide an organization and structure to address flood damage reduction in Whatcom County;
and,
WHEREAS, Resolution No. 98 -078 of the Whatcom County Council addressed the
relationship between the District and the County pertaining to the staffing of work needed to be
performed and the administrative procedures in order to fulfill the purposes of the District, and
WHEREAS, Ordinance No. 98 -064 amended the funding mechanism for the activities of
the Lynden/Everson Sub -Zone of the Flood Control Zone District and established a service
charge through December 31, 1999,
WHEREAS, the advisory bodies for the sub -zone and for the FCZD recommend
continuation of the current funding mechanism;
NOW, THEREFORE, BE IT RESOLVED, by the Whatcom County Flood Control Zone
District Board of Supervisors, that all parcels within the unincorporated and incorporated areas of
the FCZD Lynden/Everson Sub -Zone shall pay a service charge per parcel of 100 percent of the
County -wide Flood Zone assessment for all parcels within the 100 -year flood plain and/or within
200 -yards of the ordinary high water mark of the Nooksack River and 15 percent of the County-
wide Flood Zone assessment for all parcels out of the 100 -year flood plain and greater than 200 -
yards from the ordinary high water mark of the Nooksack River, with a minimum assessment of
$5.00, with the exception of the following exempt parcels:

a. All parcels owned by the Federal Government
b. All parcels classified as Indian Lands held in trust.
c. All parcels exclusively classified as mineral rights.
d. All parcels owned by the State, classified as "bedlands or tidelands"
e. All parcels with an assessed value less than or equal to $2,500.
BE IT FURTHER RESOLVED by the WCFCZD Board of Supervisors that the
Lynden/Everson Sub -Zone service charges in the same amount as stated hereinabove be extended
and imposed for the years 2000, 2001 and 2002, unless further amended.
BE IT FURTHER RESOLVED that the timing and method of collection for the
assessments hereinabove authorized, together with penalties, interest, and delinquent service
charges, shall be the same as provided for FCZD County -wide assessments in Sections 3 through
14 of Resolution No. 98 -078, as adopted by the Whatcom County Flood Control Zone District
Board of Supervisors on December 8, 1998, or as hereafter amended.
