This resolution initiates an emergency amendment to revise the Urban Fringe Subarea Plan to clarify the inten of the County
Council regarding commercial development and design standards in the Gateway Industrial District

RESOLUTION NO. 99 -022
INITIATING EMERGENCY COMPREHENSIVE PLAN AMENDMENT
WHEREAS, the Growth Management Act (RCW 36.70A.130) requires that the County
Council consider amendments to the Whatcom County Comprehensive Plan no more frequently
than once per year with certain exceptions, including emergencies; and
WHEREAS, the provisions of WCC 20.10.080 indicate that Comprehensive Plan
amendments can be initiated for processing outside of the yearly cycle, upon approval of a
resolution by a two- thirds majority of the County Council, if they constitute an emergency. An
emergency includes when expeditious action is necessary in order to preserve the health, safety
or welfare of the public or support the economic or environmental well being of the County;
WHEREAS, the Urban Fringe Subarea Plan, which was adopted as an element of the
County Comprehensive Plan, includes language relating to commercial development and design
standards in the Gateway Industrial District, which has been subject to different interpretations;
WHEREAS, expeditious review of this language to clarify its intent will preserve public
welfare and support the economic well being of the County by removing uncertainty regarding
potential opportunities for development in this area.
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council hereby
initiates an emergency amendment to revise the Urban Fringe Subarea Plan to clarify the intent
of the County Council regarding commercial development and design standards in the Gateway
Industrial District.
