1 RESOLUTION NO. 96 -049
2 IN THE MATTER OF VACATING A PORTION OF LAMPMAN ROAD
3 WHEREAS, on February 13, 1996, Larry W. Illman, et al, 2929 Lampman Road,
4 Ferndale, WA 98248, submitted a petition for the vacation of a portion of the Lampman Road,
5 approximately 660 -feet east of the Olson Road, accompanied by the penal sum of $682.00, to
6 Public Works Engineering for the vacation of the following legally described road.
7 All that portion of County Road No. 475, lying outside the right -of -way of County Roads
8 No. 409 and No. 20 in the Hunter Short Plat, as recorded in Book 8 of Short Plats, page
9 31. Said portion further described as follows:
10 Beginning at the southwest corner or Lot 3 of Hunter Short Plat, as adjusted and shown
lei on the attached Exhibit, thence North 89 °49'52" West, 70.00 feet; thence South
12 01'14'30" West, 30.01 feet; thence South 89 °49'52" east, 38.18 feet to the northerly
13 right -of -way line of County Road No. 20; thence along said right -of -way line on a curve
`,4 to the right, whose center bears South 35 °35'48" East, 180.00 feet, a distance of 36.38
'J feet; thence North 01'14'30" East, 13.08 feet to the Point of Beginning. All situate in
16 the southeast one quarter of the northeast one quarter of Section 35, Township 39 North,
17 Range 1 East of W.M., Whatcom County, WA.
18 WHEREAS, the County Engineers office has reviewed the portion of roadway which is
19 a Class B road, wherein no public expenditures were made and a Class 1 road wherein no part
20 lies within a plat. Due to the other adequate right -of -way width, it is not necessary for future
21 maintenance or improvement to this portion of Road No. 475 being petitioned for vacation, and
22 WHEREAS, the petitioner has met all of the petition requirements, as set forth by
23 Chapter 12.20, Whatcom County Code and all other applicable laws, and
24 WHEREAS, the County Engineer recommends approval of this vacation.
25 WHEREAS, the applicant has six calendar months from the date the Resolution is passed
26 to pay any remaining fees to the Whatcom County Council office, with checks made payable to
27 the Whatcom County Treasurer, prior to the vacation becoming effective, including but not
28 limited to the appraised value of the area sought to be vacated.

WHEREAS, this vacation does not become effective until the fees are paid and the Final
Order and Resolution are recorded with the County Auditor.
WHEREAS, the appraised value of the area sought to be vacated is $300.00.
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
above described portion of Lampman Road as petitioned for by Larry W. Illman, et al, be
hereby vacated.
