RESOLUTION NO. 96 -044
A RESOLUTION ADOPTING A RECOMMENDATION FOR THE 1996 WOODSIDE
CHURCH OPEN SPACE / OPEN SPACE APPLICATION
WHEREAS, The Planning Commission received the Woodside Church application for
Open Space land tax assessment for review and recommendations pursuant to RCW 84.34; and
WHEREAS, pursuant to WAC Section 197- 11- 800(6)(c), matters relating to Open Space
taxation are determined not to be major actions and are exempt from the threshold determination
and environmental impact statement requirements of the State Environmental Policy Act; and
WHEREAS, pursuant to RCW 36.70.390, legal notice was published in the Bellingham
Herald on May 12, 1996, and a copy of said notice was sent in a timely manner to all applicants;
and
WHEREAS, on May 23, 1996, the Planning Commission opened the public hearing on the
application and received testimony from the Planning Division staff regarding the proposed Open
Space/Open Space parcel; and
WHEREAS, Open Space /Open Space evaluations are based upon the Public Benefit
Rating System; and
WHEREAS, the Planning Commission concurred with the Planning Division's
recommendations for approval of the Open Space /Open Space application; and
WHEREAS, the Planning Commission has forwarded its recommendation to Council; and
WHEREAS, Council held a public meeting on June 25, 1996 to consider the Planning
Commission's recommendation, and postponed the decision regarding the application until a July
23, 1996 public meeting to accommodate the Woodside Church Pastor who was out of town.
NOW THEREFORE BE IT RESOLVED BY THE WHATCOM COUNTY COUNCIL:
1. The Whatcom County Council approves the Public Benefit Ratings of the Open Space/Open
File: #OS: 1996, Page 2
Space application for Bellingham CORS (Woodside Church) (PBR 45.57).
2. An additional condition for approval for the Bellingham CORS (Woodside Church) application
is the agreement to allow public access (per Guidelines) on adjacent woodlands within the 5 acre
tax exempt portion of this parcel (Parcel 4 of Woodside Estates Short Plat); and
3. The Council directs the Assessor to place the parcel in the appropriate Open Space status
category.
4. Adjudication of invalidity of any of the sections, clauses or provisions of this Resolution shall
not affect or impair the validity of the Resolution as a whole or any part thereof other than the
part so declared to be invalid.
