On Thursday, ,lone 13, 1996, the Planning Commission voted unanimously to extend the Interim Zoning0rdinance for one year,
sided that land use planning efi'orts were initiated in order to adopt permanent zoning within the Lummi Reservation. The
hed resolution contains the Planning Commission recommendation for the Lurrimi Nation to propose land use designations
as a precursor to permanent zoning on the Reservation.
ORIGINATOR'S REC.OMMENI)ED ACTION: The Director of Planning & Development Services recommends the
Council uphold the Planning Commission recommendations as described in the al.tached resolution.

2 DECLARATION OF INTENT REGARDING LAND USE PLANNING ON THE LUM II
3 INDIAN RESERVATION
4 WHEREAS, Whatcom County desires to cooperate with the Lummi Tribe in achieving
5 compatible zoning and enforcement of that zoning within the boundaries of the Reservation; and
6 WHEREAS, an Intergovernmental agreement written in 1982 addresses co- existing
7 jurisdiction occurring within the Reservation whereby County and Tribal governments will
8 represent and assume responsibility for lands each has jurisdiction over;
9 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
10 Executive is requested to take the lead in proposing land use designations based on an open public
11 process, including the interests of all residents of the Reservation. A report from County staff is
12 requested to be given to the County Planning Commission in September 1996 and February 1997
13 on the progress of this planning effort. The Tribal Planning Commission and tribal staff should be
14 invited to participate in joint meetings. The Council desires that by March of 1997, Whatcom
15 County Planning & Development Services staff initiate the final adoption process for appropriate
16 zoning of fee lands within the Reservation.
