ANALYSIS OF THE CREATION OF AFFORDABLE HOUSING 7 WHEREAS, Whatcom County has an opportunity to apply to the State Department of 8 Community, Trade, and Economic Development for funding assistance; and, 9 10 WHEREAS, it is necessary that certain conditions be met as part of the application 11 requirements; and, 12 13 WHEREAS, Pete Kremen, the chief administrative official of Whatcom County, is 14 authorized and has been requested by resolution of the Whatcom County Council to submit this 15 application to the State of Washington on behalf of Whatcom County. 16 17 18 NOW, THEREFORE, BE IT RESOLVED that Whatcom County authorizes submission 19 of this application to the State Department of Community, Trade, and Economic Development to 20 request $24,000 to assist in the planning for and feasibility analysis of the creation of affordable 21 housing, and certifies that, if offered a grant and the grant is accepted, then Whatcom County, 22 through the Whatcom Housing Authority: 23 24 1. Will comply with applicable provisions of Title I of the Housing and Community 25 Development Act of 1974, as amended, and other applicable state and federal 26 laws; Page 1 1 2. Has a draft. or final GMA Comprehensive Plan and will maintain a copy on file 2 with the State Department of Community, Trade, and Economic Development; 3 4 3. Has adopted and is following a citizen participation strategy which provides 5 opportunities for citizen participation comparable to the state's requirements 6 (those described in Section 104(a)(2)(3) of the Housing and Community 7 Development Act of 1974, as amended); has complied with all public hearing 8 requirements and provided citizens, especially low- and moderate - income persons, 9 with reasonable advance notice of, and the opportunity to present their views 10 during the assessment of community development and housing needs, during the 11 review of available funding and eligible activities, and on the proposed activities; 12 13 4. Has provided technical assistance to citizens and groups representative of low- and 14 moderate - income persons that request assistance in developing proposals; 15 16 5. Will provide opportunities for citizens to review and comment on proposed 17 changes in the funded project and program performance; 18 19 6. Will not be using CDBG funds in this project for the capital costs of public 20 improvements and will not use assessments against properties owned and occupied 21 by low- and moderate - income persons to, nor charge user fees to, recover the 22 capital costs of CDBG - funded public improvements from low- and moderate - 23 income owner- occupants; 24 25 7. Will establish a plan to minimize displacement as a result of activities assisted with 26 CDBG funds; and assist persons actually displaced as a result of such activities, as 27 provided in the Uniform Relocation Assistance and Real Property Acquisition 28 Policies Act of 1970, as amended; 29 30 8. Will conduct and administer its program in conformance with Title VI of the Civil 31 Rights Act of 1964 and the Fair Housing Act, and will affirmatively further fair 32 housing, (Title VIII of the Civil Rights Act of 1968); and 33 34 9.
