On May 23, 1996, the Planning Commission recommended approval for ten applications. Two applications for Open Space/Farm & Agriculture Conservation were recommended for denial and three applications to transfer Designated Forest to Open Space/Timber were recommended for denial. In addition, the Planning Commission recommended a requirement for the Bellingham CORS (Woodside Church) application to not develop 4.5 adjoining acres as a condition of approval. ORIGINATOR'S RECOMMENDED ACTION. • The Director of Planning & Development Services recommends the Council uphold the Planning Commission recommendations as shown in the attached draft resolution. COMMITTEE ACTION TAKEN: COUNCIL ACTION TAKEN.• 1996 - 246 6/25/96: Amended & Approved 7 - 0 W, dinance or Resolution Number (this item only): a�3-7 r] 4/ -^0" -t File: #OS: 1996, Pagel INTRODUCED BY: conGani- PROPOSED BY: PLANNING DATE: 6/25/96 RESOLUTION NO. 96 -037 A RESOLUTION ADOPTING RECOMMENDATIONS FOR 1996 OPEN SPACE/ OPEN SPACE, OPEN SPACE/FARM & AGRICULTURE CONSERVATION and OPEN SPACE/TIMBER APPLICATIONS WHEREAS, The Planning Commission received ten (10) new applications and five (5) transfer applications for Open Space land tax assessment for review and recommendations pursuant to RCW 84.34, and WHEREAS, pursuant to WAC Section 197- 11- 800(6)(c), matters relating to Open Space taxation are determined not to be major actions and are exempt from the threshold determination and environmental impact statement requirements of the State Environmental Policy Act; and WHEREAS, pursuant to RCW 36.70.390, legal notice was published in the Bellingham Herald on May 12, 1996, and a copy of said notice was sent in a timely manner to all applicants; and WHEREAS, on May 23, 1996, the Planning Commission opened the public hearing on the applications and received testimony from the Planning Division staff regarding the proposed Open Space /Open Space, Open Space/ Timber, and Open Space/Farm & Agriculture Conservation parcels; and WHEREAS, Open Space /Open Space and Open Space/Farm & Agriculture Conservation evaluations are based upon the Public Benefit Rating System and Open Space /Timber is evaluated upon conformance with RCW 84.34.041; and WHEREAS, the Planning Commission recommends approval of the Open Space/Farm & Agriculture Conservation applications from Ali and McLeod; denial of the Open Space/Farm & Agriculture Conservation applications from Clearman and Walton; and WHEREAS, the Planning Commission recommends approval of the Open Space /Open Space applications from Clendenen, Lampshire and Bellingham CORS (Woodside Church); and WHEREAS, the Planning Commission further recommended that as a condition of File: #OS.- 1996, Page 2 approval, Bellingham CORS (Woodside Church) agrees to not develop 4.5 acres adjoining their parcel; and WHEREAS, the Planning Commission recommends approval of Open Space /Timber applications from Jones, Nygren and Schiffmacher; and approval of the transfer Pram Designated Forest to Open Space /Timber from Blunt and deJong; and WHEREAS, the Planning Commission recommends denial of the applications to transfer from Designated Forest to Open Space /Timber from Bruce Flint, Scott Flint and Susan Flint; and WHEREAS, the Planning Commission has forwarded its recommendations to Council; and WHEREAS, Council held a publ.ic meeting on June 25, 1996 to consider the Planning Commission's recommendations. NOW THEREFORE BE IT RESOLVED BY THE WHATCOM COUNTY COUNCIL: 1. The Whatcom County Council approves the Public Benefit Ratings of the Open Space /Open Space applications for: Clendenen (PBR 104.98), and Lampshire (PBR 55.42). 2. The Whatcom County Council approves the Public Benefit Ratings of the Open Space/Farm & Agriculture Conservation applications for: Ali (PBR 48.47) and McLeod (PBR 78.69). 3. The Whatcom County Council denies the Open Space/Farm & Agriculture Conservation applications for: Clearman (PBR 40.66) and Walton (PBR 16.56). 4. The Whatcom County Council approves the Open Space /Timber applications for: Jones, Nygren and Schiffmacher. 5. The Whatcom County Council approves the applications for transfer from Designated Forest to Open Space /Timber for: Blunt and deJong. 6. The Whatcom County Council denies the three applications to transfer from Designated Forest to Open Space /Timber for: Bruce Flint, Scott Flint, and Susan Flint. 7. The Whatcom County Council will hold in committee the the Bellingham CORS (Woodside Church) application; and 8. The Council directs the Assessor to place the parcels in the appropriate Open Space status category. File: #OS.• 1996, Page 3 9. Adjudication of invalidity of any of the sections, clauses or provisions of this Resolution shall not affect or impair the validity of the Resolution as a whole or any part thereof other than the part so declared to be invalid.
