Following the hearing, the Treasurer recommends that the resolution be passed. COMMITTEE ACTION TAKEN: COUNCIL ACTION TAKEN.- 1996-211A 5/28/96: Introduced 6/25/96: Approved 7 - 0 znce or Resolution Number (this item only): -Aes. 9 (o-031 SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 5/29196 - 1 RESOLUTION NO. 96 -034 2 TO SELL PROPERTY ACQUIRED BY COUNTY ON TAX FORECLOSURE 3 REQUEST NO. 96 -3 4 WHEREAS, RCW 84.64.270 allows the County to sell real estate acquired by tax 5 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; 6 and, 7 WHEREAS, the Whatcom County Property Management Committee recommends the 8 sale of the subject property; and, 9 WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said 10 unit of property and to determine whether or not a contract will be allowed, or if it will be a 11 cash price; and, 12 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County 13 to sell parcel #400131 - 031326 -0115 having legal description of: CABANA CLUB 14 CONDOMINIUM UNIT 109 - UNDIV 1/48 INT IN TSU E -29, to the highest and best 15 bidder, for no less than $ 1.00 ; and, 16 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and 17 shall be paid in either cash, certified check, or money order to the Whatcom County Treasurer 18 at the time of sale; and, 19 BE IT FURTHER RESOLVED that said lot shall be sold subject to the restrictive 20 covenant allowing for imposition of Community Association fees, if any, as set forth in 21 Whatcom County Resolution No. 88 -37; and, 22 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed 23 to sell such property at not less than a certified price and said sale shall take place in 24 accordance with the duties as established in RCW 84.64.270. 25 APPROVED this 95 day of Tune , 1996. 26 27 ATTEST: 0 28 29 n- avis, ncil Jerk 30 APPROVED AS TO FORM: 31 Aizaj��� 32 Civil Deputy Prosecuting Attorney WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON L. and Nelson, Chair
