1 RESOLUTION NO. 96 -033
2 TO GRANT BACK COUNTY RIGHT -OF -WAY
3 REQUEST NO. 96 -1
4 WHEREAS, RCW 36.34.010 allows the County to sell real estate belonging to the County
5 where it is found to be in the best interest of Whatcom County to sell the same; and,
6 WHEREAS, the Whatcom County Property Management Committee has recommended the
7 sale of the subject property; and,
8 WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said unit
9 of property and to determine whether or not a contract will be allowed or if it will be a cash price;
10 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to
11 donate right -of -way with legal description of: A PARCEL OF LAND IN THE SW QTR OF THE
12 SW QTR OF SEC 4, TWN 40 N, RNG 1 E. BEG 645 FT N AND 30 FT E OF THE SEC
13 CORNER COMMON TO SECS 4,5,8 AND 9, TWN 40 N RNG 1 E; THENCE EASTERLY AT
14 RIGHT ANGLES TO THE SEC LINE BETW SAID SECS 4 AND 5, 30 FT; THENCE
15 NORTHERLY PARALLEL WITH SAID SEC LINE 405 FT; THENCE WESTERLY AT RIGHT
16 ANGLES TO SAID SEC LINE 30 FT; THENCE SOUTHERLY PARALLEL WITH SAID SEC
17 LINE 405 FT TO THE POB. BASIS OF DESCRIPTION: AF 1058002 REF PARCEL# 400104-
18 014091. THE COUNTY RESERVES A PERMANENT EASEMENT OVER THE ABOVE -
19 DESCRIBED PARCEL FOR THE PURPOSE OF MAINTAINING THE EXISTING ROADWAY,
20 EMBANKMENT AND DRAINAGE FACILITIES, to the current owner of parcel 400104- 014091
