C) (-0 - 0 aS SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 5/28/96 1 RESOLUTION NO. 96 -025 2 HEARING AND NOTICE OF HEARING ON GRANTING BACK COUNTY RIGHT -OF -WAY 3 REQUEST NO. 96 -1 4 WHEREAS, the following described property is now, and has been a right -of -way of the 5 County of Whatcom, State of Washington since 1969; and 6 WHEREAS, the Whatcom County Council does deem it in the best interest of the County and 7 the people thereof that said right -of -way be disposed of, and, 8 WHEREAS, the Whatcom County Assessor, Engineering, Parks, Planning, and Public Works 9 Departments were contacted and expressed no interest in retaining this right -of -way for County use; 10 and, 11 WHEREAS, the Whatcom County Property Management Committee recommends the 12 disposition of the subject right -of -way; 13 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to 14 donate right -of -way with legal description of: A PARCEL OF LAND IN THE SW QTR OF THE 15 SW QTR OF SEC 4, TWN 40 N, RNG 1 E. BEG 645 FT N AND 30 FT E OF THE SEC 16 CORNER COMMON TO SECS 4,5,8 AND 9, TWN 40 N RNG 1 E; THENCE EASTERLY AT 17 RIGHT ANGLES TO THE SEC LINE BETW SAID SECS 4 AND 5, 30 FT; THENCE 18 NORTHERLY PARALLEL WITH SAID SEC LINE 405 FT; THENCE WESTERLY AT RIGHT -19 ANGLES TO SAID SEC LINE 30 FT; THENCE SOUTHERLY PARALLEL WITH SAID SEC A LINE 405 FT TO THE POB. BASIS OF DESCRIPTION: AF 1058002 REF PARCEL# 400104- 21 014091. THE COUNTY RESERVES A PERMANENT EASEMENT OVER THE ABOVE - 22 DESCRIBED PARCEL FOR THE PURPOSE OF MAINTAINING THE EXISTING ROADWAY, 23 EMBANKMENT AND DRAINAGE FACILITIES, to the current owners of parcel 400104 - 014091 24 Janine L.
