This resolution forwards the request for annexation to the Whatcom County Auditor for inclusion on the November 4 general election ballot. Imhof & Starkenburg absent. belated File Numbers: Ordinance or Resolution Number (this item only): I watdisres9 /18/97 SPONSORED BY: Consent 2 PROPOSED BY: Citizen 1 INTRODUCTION DATE: 9/9/97 2 RESOLUTION NO. 97 -058 3 SUBMITTING PROPOSED ANNEXATION OF THE GLACIER GREEN AREA 4 INTO THE GLACIER WATER DISTRICT TO THE VOTERS AT THE NOVEMBER 5 GENERAL ELECTION 6 WHEREAS pursuant to the provisions of RCW 57.24 the Whatcom County Council 7 received a request for water district annexation via petition containing signatures of at least ten 8 percent of the registered voters in the Glacier Green area, along with a certificate of concurrence 9 from the Glacier Water District Commissioners; and 10 WHEREAS, receipt of this petition and certificate of concurrence began the process for 11 annexation into a water district as outlined in RCW 57.24; and 12 WHEREAS the Whatcom County Council held a public hearing on the matter of 13 annexation of the Glacier Green area into the Glacier Water District on September 18, 1997. 4 NOW THEREFORE BE IT RESOLVED that the Whatcom County Council finds the .5 proposed annexation to be conducive to the public health, welfare, and convenience and to be of 16 special benefit to the land proposed to be annexed and included within the boundaries of the 17 district; and 18 BE IT FURTHER RESOLVED that the Whatcom County Council submits the proposed 19 annexation of the Glacier Green area into the Glacier Water District to the Whatcom County 20 Auditor for inclusion on the ballot for the November 4, 1997 general election; and 21 BE IT FURTHER RESOLVED that the election on this matter will take place within the 22 boundaries of the territory proposed to be annexed to the Glacier Water District as outlined in 23 Exhibit A to this resolution; and 24 BE IT FURTHER RESOLVED that the proposition to the voters shall be expressed on 25 ballots which contain the words: 26 For Annexation to District 27 or 28 Against Annexation to District Page 1 BE IT FINALLY RESOLVED that the Whatcom County Council shall name the 2 persons to act as judges at the election. 3 APPROVED this 18 day of septemberl997. 4 5 ATTEST:, 6 7 ro - avis, Clerk of the Council 8 APPRO ED AS TO FORM: g 10 Civil Deputy Prosecutor Page 2 WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON L. Ward Nelson, Council Chair 1 EXHIBIT A 2 The election on the matter of annexation of the area known as Glacier Green into the Glacier 3 Water District shall take place within the following boundaries: 4 That portion of Government Lots 8, 9, and 10 of Section 34, Township 40 North, 5 Range 6 East, W.M., whose boundaries are: 6 Beginning at the most southerly point of Lot 16 of Glacier Greene Subdivision, 7 thence north 02 degrees 02'30" west a distance of 2208.10 feet to the northerly 8 line of Government Lot 9, thence south 88 degrees 38'18" west a distance of 9 1443.02 feet to the most westerly corner of Lot 1, Glacier Greene Subdivision, 10 thence in a southeasterly direction along the southwesterly right -of -way line of the 11 Glacier Greene Subdivision, along the northeasterly right -of -way line of the Mt. 12 Baker Highway (State Highway #542) a distance of 2652.55 feet more or less to 13 the point of beginning. 14 Page 3
