SUBJECT. Resolution scheduling a public hearing in the matter of creating a Flood Control Zone District Sub -
Zone in the Sumas /Nooksack/Everson area.

MMARY: RCW 86.15.025 authorizes the Division of the County -wide Flood Control Zone District into
separately design4ted sub - zones, and authorizes the establishment of such sub -zones by Resolution of.the Council.
Residents of the area have requested the creation of a Flood Control sub -zone district and the Flood Control Zone
District Advisory Committee has officially endorsed formation of said sub -zone. This Resolution will schedule a
public hearing to consider establishment of said sub -zone.

2 SCHEDULING A PUBLIC HEARING CONCERNING
3 THE ESTABLISHMENT OF A FLOOD CONTROL ZONE DISTRICT SUB -ZONE
4 WHEREAS, RCW 86.15.025 authorizes the division of the County -wide Flood Control
5 Zone District into separately designated sub - zones; and
6 WHEREAS, the draft Comprehensive Flood Hazard Management Plan for the Lower
7 Nooksack River recommends the formation of sub -zones in certain reaches and flood areas, and
8 WHEREAS, residents of the Sumas /Nooksack/Everson area have requested the formation
9 of such a sub -zone; and
10 WHEREAS, a map and legal description of said Sumas /Nooksack/Everson sub zone is
11 included in this Resolution as Attached Exhibit "A".
12 NOW, THEREFORE, BE IT RESOLVED, a Public Hearing to consider the
l3 establishment of a sub -zone will be held at the September 23 regular County Council Meeting
14 or at a later date.

LEGAL DESCRIPTION
A subzone district comprised of all or part of sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 14, 15, 16,
17, 18, 19, 20, 21, 22, 28, 29, 30,3t and 32 of Township 39 North, Range 4 East of W.M.
AND all or part of sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23,
24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35 and 36 of Township 40 North, Range 4 East of
W.M.
AND all or part of sections 31, 32, 33, 34, 35 and 36 of Township 41 North, Range 4 East of
W.M.
AND all or part of sections 1, 2, 11, 12 and 13 of Township 40 North, Range 3 East of W.M.
