SUBJECT: Resolution scheduling a public hearing in the matter of creating a Flood Control Zone District Sub -
Zone in the Acme /VanZandt area.

MMARY: RCW 86.15.025 authorizes the Division of the County -wide Flood Control Zone District into
separately designated sub - zones, and authorizes the establishment of such sub -zones by Resolution of the Council.
Residents of the area have requested the creation of a Flood Control sub -zone district and the Flood Control Zone
District Advisory Committee has officially endorsed formation of said sub -zone. This Resolution will schedule a
public hearing to consider establishment of said sub -zone.

2 SCHEDULING A PUBLIC HEARING CONCERNING
3 THE ESTABLISHMENT OF A FLOOD CONTROL ZONE DISTRICT SUB -ZONE
4 WHEREAS, RCW 86.15.025 authorizes the division of the County -wide Flood Control
5 Zone District into separately designated sub - zones; and
6 WHEREAS, the draft Comprehensive Flood Hazard Management Plan for the Lower
7 Nooksack River recommends the formation of sub -zones in certain reaches and flood areas, and
8 WHEREAS, residents of the Acme /VanZandt area have requested the formation of such
9 a sub -zone; and
10 WHEREAS, a map and legal description of said Acme /VanZandt sub zone is included
11 in this Resolution as Attached Exhibit "A ".
12 NOW, THEREFORE, BE IT RESOLVED, a Public Hearing to consider the
13 establishment of a sub -zone will be held at the September 23 regular County Council Meeting
.4 or at a later date.

LEGAL DESCRIPTION
A subzone district comprised of all or part of sections 7, 8, 9, 10, 15, 16, 17, 18, 19, 20, 21, 22,
27, 28, 29, 30, 31, 32, 33, 34 and 35 of Township 38 North, Range 5 East of W.M.
AND all or part of sections 12, 13, 14, 23, 24, 25, 26, 35 and 36 of Township 38 North, Range
4 East of W.M.
AND all or part of sections 1, 2, 11, 12, 13 of Township 37 North, Range 4 East of W.M.
AND all or part of sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 15, 16, 17, 18, 21, 22, 23, 24, 26 and 27
of Township 37 North, Range 5 East of W.M.
The perimeter of said subzone more particularly described as follows:
commencing at the Southwest corner of section 13, said T37N, R4E, and being the true point of
beginning; thence North one mile, to the Southeast corner of section 11, T37N, R4E; thence West
3/4 of a mile, to the Southwest corner of the Southeast one quarter of the Southwest one quarter
of said section 11; thence North one mile to the Southwest corner of the Southeast quarter of the
Southwest quarter of section 2, T37N, R4E; thence East 1/4 mile, to the South quarter corner of
said section 2; thence North 3 miles to the South quarter corner of section 23, T38N, R4E; thence
West one -half mile to the Southwest corner of said section 23; thence North 2 miles to the
Northwest corner of section 14, T38N, R4E; thence East one mile to the Southwest corner of
