Res. #97 -050 nance or Resolution Number (this item only): SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: $/12//97 1 RESOLUTION NO. 97 -050 2 TO SELL PROPERTY ACQUIRED BY COUNTY ON TAX FORECLOSURE 3 REQUEST NO. 7 -� 4 WHEREAS, RCW 84.64.270 allows the County to sell real estate acquired by tax 5 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; and, 6 WHEREAS, RCW 84.64.320 allows for Tax Title property to be disposed of without bids 7 when the county legislative authority determines that it is not practical to build on the property due 8 to the physical characteristics of the property or legal restrictions on construction activities on the 9 property; and, 10 WHEREAS, the Whatcom County Property Management Committee recommends the sale 11 of the subject property which was acquired by the county on December 14, 1995 at which time 12 a public auction was held and no acceptable bids were received; and, WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as negotiator _ r in such sales; and, 15 WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said units 16 of property and to determine whether or not a contract will be allowed, or if it will be a cash price; 17 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to 18 sell the following parcel for a price to be negotiated by the Whatcom County Treasurer of no less 19 than the minimum price shown below: 20 Parcel 21 390535- 035297 -0000 22 23 THAT PTN OF LD CONV TO MCCOY - LOGGIE 24 TIMBER CO AS A 50 FT R/W Ilv AF 191310 25 EXACT LOCATION BEING UNDETERMINED 26 IN THAT PTN OF LD IN S 1/2 OF GOVT LOT 1 27 LY W OF W LI OF CO RD 314 (MOSQUITO 28 LAKE RD) -EXC THEREFROM E 210 FT OF S 194.95 FT 29 30 Minimum Price $ 10.00 and, Request No.97 -1 Page 1 32 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall 33 be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the '4 time of sale; and, 35 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to 36 sell such property at not less than a certified price and said sale shall take place in accordance with 37 the duties as established in RCW 84.64.270. 38 APPROVED this 9 day of September , 1997. 39 40 ATTEST: 41 42 Brown- is, ouncil Clerk 43 APPROV D AS TO FORM: 44 ivil Deputy Prosecuting Attorney WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON � F.00i'M "A L.
