The County Executive requests authorization to enter into contracts and documents necessary to complete the
Riverberry/VanDellan project in excess of $35,000 within an amount not to exceed $1,125,000 without further County Council
approval.

1 RESOLUTION NO. 97 -044
2 RESOLUTION BY THE WHATCOM COUNTY FLOOD CONTROL ZONE
3 DISTRICT BOARD OF SUPERVISORS REGARDING
4 AMENDING ADMINISTRATIVE CONTRACT APPROVAL AMOUNTS FOR
5 EMERGENCY FLOOD CONTROL WORKS AND
6 FISHERY HABITAT ENHANCEMENT ALONG THE BANKS OF THE
7 NOOKSACK RIVER
8 WHEREAS, Resolution #97 -026 was approved by the County Council on June 3, 1997 with
9 an amendment for a not to exceed amount of $1,250,000 on July 29, 1997 for emergency flood
10 control work; and,
11 WHEREAS, the County Executive has authorized an emergency project designation as
12 provided under Whatcom County Code 3.08.060(5) which waives the requirements governing
13 competitive bids with reference to any purchase or contract. and,

15 WHEREAS, it is necessary due to the emergency nature due to the limited fishery window
16 available during the summer of 1997 and to provide a reduction of flood threat and control of the
17 erosion in this specific area is in the best interests of the citizens of Whatcom County.
18 NOW, THEREFORE, BE IT RESOLVED that the County Executive is hereby granted the
19 authority to enter into any and all contracts and documents necessary, in excess of $35,000, for the
20 purchase of wood debris /timber logs, concrete dolos and other items as necessary for the construction
21 of the aforementioned project without further County Council approval or action necessary.
22 BE IT FURTHER RESOLVED that by adoption of this resolution it is not the intent of the
23 Whatcom County Flood Control Zone District Board of Supervisors to establish any ongoing policies
24 or, programs in this regard except as they may specifically apply to this project.
