SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE; 3/17/2015 RESOLUTION NO. 2015 -007 TO SET HEARING AND NOTICE OF HEARING OF THE SALE OF COUNTY TAX TITLE PROPERTY BY NEGOTIATION REQUEST NO. TR2015 -01 1 WHEREAS, the following described property is now, and has been the property of 2 the County of Whatcom, State of Washington since: as noted per parcel below; and, 3 WHEREAS, the Whatcom County Property Management Committee recommends 4 the resolution be passed to effectively meet the legal requirement for the disposal by 5 negotiation pursuant RCW 36.35.150(2) ), when the county legislative authority determines 6 that it is not practical to build on the property due to the physical characteristics of the 7 property or legal restrictions on construction activities on the property. Subject to a 8 covenant to bind; and, 9 WHEREAS, the Whatcom County Property Management Committee recommends 10 its sale by negotiation; and, 11 WHEREAS, the Whatcom County Property Management Committee recommends 12 the Whatcom County Treasurer enter into negotiations with the applicant; and, 13 WHEREAS, the principal taxes, interest, penalties, title search and foreclosure costs 14 total 750.00; and, 15 WHEREAS, the Whatcom County Council does deem it in the best interest of the 16 County and the people thereof that said property be sold for no less than the principal 17 taxes, interest, penalties, title search and foreclosure costs; and, 18 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as 19 negotiator in such sales; and, 20 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for 21 said units of property and to determine whether or not a contract will be allowed, or if it will 22 be a cash price; 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to sell for a price to be negotiated by the Whatcom County Treasurer, the following Tax -Title property acquired 12/14/1963, Parcel # 370505.393475.0000 / PID 36475 E 20 FT OF GOVT LOT 2 -SUBJ TO ESMT FOR RD R/W REC IN VOL 343 -D -426 TAX CASE 1556, WHATCOM COUNTY, WASHINGTON TWN 37N RGE 05E SEC 05 For no less than the principal taxes, interest, penalties, title search and foreclosure costs of $750.00 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public hearing on the matter of the sale of said property, under said terms, be held on the 31st day of March 2015, at 7:00 p.m., at the Whatcom County Courthouse Whatcom County, Washington; and, 39 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall 40 give notice of such hearing in the manner prescribed by law under RCW 36.34.030. 41 42 43 44 45 io 47 48 APPROVED this 17tH day of C'0 U /V .r ATTEST: co`�� r aF •W Dan r - Brown =l7vi; Cauncl Clerk %1 ➢! ; i 1111y`� March 2015 WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON Carl Weimer, Chair of the Council
