1 RESOLUTION NO. 98 -072
2 IN THE MATTER OF VACATING A DEEDED RIGHT -OF -WAY
3 WHEREAS, on October 28, 1997, Cleo Callen, et al, 8024 Dean Drive, Custer, WA
4 98240, submitted a petition for the vacation of a portion of the northerly edge of Slater Road
5 lying 625 -ft. westerly of LaBounty Road, accompanied by the penal sum of $682.00, to Public
6 Works Engineering for the vacation of the following legally described road:
7 Beginning at the northeast corner of Section 4, Twp. 38 N., Rge. 2 E.; thence North
8 89 °57 14" West 734.39 feet to the west right -of -way line of Labounty Road shown on
9 Record of Survey AF #950210025; thence South 01'04'40" East 474.28 feet; thence
10 North 80 °23'39" West 625.88 feet to the true point of beginning; thence North
11 01 °02'23" West 74.76 feet: thence north 88 °23'57" West 195.00 feet; thence South
12 10 °27'07" East 49.31 feet; thence South 80 °23'39" East 190.00 feet to the true point of
13 beginning. Consisting of 11,681 square feet.
14 WHEREAS, the County Engineers office has reviewed the portion of roadway which is
15 a Class A road, wherein public expenditures were made and it was opened for public use within
16 five or more years after the order was made or authority granted for opening it.
17 WHEREAS, the petitioner has met all of the petition requirements, as set forth by
18 Chapter 12.20, Whatcom County Code and all other applicable laws, and
19 WHEREAS, the County Engineer recommends approval of this road vacation; and
20 WHEREAS, the applicant has six calendar months from the date the Resolution is passed
21 to pay any remaining fees to the Whatcom County Council office, with checks made payable to
22 the Whatcom County Treasurer, prior to the vacation becoming effective, including but not
23 limited to the appraised value of the area sought to be vacated.
24 WHEREAS, this vacation does not become effective until the fees are paid and the
25 Final Order and Resolution are recorded with the County Auditor.
26 WHEREAS, the appraised value of the area sought to be vacated is $17,521.50.
27 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the above
28 described right -of -way, as petitioned for by Cleo Callen, et al, be hereby vacated upon payment
1 by petitioner of all the requisite amounts of fees and of the appraised value of the property,
2 provided that such payment is completed within six months of the passage of this resolution.
