INTRODUCTION DATE:
RESOLUTION NO. 98 -065 9/29/98
WHEREAS, Whatcom County, as lead agency, has under ESHB 2514, entered into a
contract with the Washington State Department of Ecology for a grant (grant no.G9800292) to
produce a management plan for Nooksack WRIA #1; and
WHEREAS, Whatcom County, the city of Bellingham, and PUD #1 are designated as
three of the initiating governments under ESHB 2514, and, in accordance with the same, have
invited the Lummi Nation and the Nooksack Tribe, as the affected tribes in WRIA #1, to
participate as initiating governments in the watershed planning process; and
WHEREAS, in response to this invitation, the Lummi Nation has submitted a final
version of a Memorandum of Agreement (MOA) to participate as one of the initiating
governments; and
WHEREAS, the appointed representatives of Whatcom County, the city of Bellingham,
and Whatcom County PUD #1 have collectively reviewed this MOA, and have found that it
fairly represents the spirit and intent of ESHB2514 in combination with the 2514 contract
between Whatcom County and the Washington State Department of Ecology, and that the MOA
is acceptable as an agreement that the ESHB 2514 planning process shall include the Lummi
Nation participating as an initiating government; and
WHEREAS, the above appointed representatives of the three initiating governments have
found that it is vitally important to the public interest that the MOA now be adopted by all four
signatories without delay;
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that
Whatcom County Executive shall execute the final version of the MOA for ESHB 2514
submitted by the Lummi Nation.
