COMMITTEE ACTION TAKEN: COUNCIL ACTION TAKEN• 1998-301 7/28/98: Approved 5 -1, Brown opposed, Nelson absent, Resolution #98 -054 ance or Resolution Number (this item only): p eS*98-OSq 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 SPONSORED BY: Consent PROPOSED BY: Consent INTRODUCTION DATE: 7/28/98 RESOLUTION NO. 98 -054 A RESOLUTION FOR RECONVEYANCE OF FOREST BOARD LAND TO WHATCOM COUNTY (SOUTH FORK OF THE NOOKSACK RIVER) WHEREAS, Whatcom County is authorized to develop public recreation facilities and to coordinate with other governmental agencies; and WHEREAS, Whatcom County recognizes the need to preserve natural resources for future generations; and WHEREAS, Whatcom County intends to establish a regional park facility along the South Fork of the Nooksack River; and WHEREAS, Whatcom County has identified this property in the Whatcom County Comprehensive Plan and in the "Preserving a Way of Life ": A Natural Heritage Plan for Whatcom County; and WHEREAS, the needs identified in support of the reconveyance may include, but are not limited to, the following facilities or activities: trails, camping, nature areas, interpretive areas, picnicking, fishing, wild life photography, birdwatching, including support facilities; and WHEREAS, Whatcom County has determined that the reconveyance of approximately 200 acres of State Forest Board land is needed for public park use in accordance with the Whatcom County Parks and Recreation section of the County's Comprehensive Plan and the State Outdoor Recreation Plan; and, WHEREAS, Whatcom County has filed with the Washington State Department of Natural Resources for the reconveyance of the identified forest land in accordance with R.C.W. 76.12.072; and THEREFORE, BE IT RESOLVED, by the Whatcom County Council that the reconveyance of the Forest Board property is situated in the State of Washington, County of Whatcom and is described as follows: The E% of the NE' /4, Government Lots 1, 2, 6, 7, and 10, Section 16, also, easements for road purposes /right of ways as described under Whatcom County Auditor File Nos. 663311 and 712993, the West 20 acres of the NW% of Section 15; also easements for road purposes /right of way as described under Whatcom County Auditor's File Nos. 663311 and 712993 in Township 37 N., Range S E., W.M., containing 200 acres, more or less 46 be initiated by Whatcom County and ultimately managed and operated by the Whatcom County 47 Parks and Recreation for public park and recreation use. 48 49 THEREFORE, BE IT FURTHER RESOLVED, by the Whatcom County Council that 50 this land is to be for park purposes as part of the regional park on the South Fork of the Nooksack 51 River. 52 53 ADOPTED this 28 day of July , 1998. 54 55 56 57 glerrk- 61 58 59 60 62 APPROVED AS TO FORM: 63 64 l 65 Civil Deputy Prose u r WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON RU VA A. BELCHER, Commissioner of Public.Lands APPLICATION FOR RECONVEYANCE OF FOREST BOARD LANDS I, Pete Kremen. , representing Whatcom County hereby apply for the reconveyance of -the following described Forest Board lands situated in , Whatcom County: Legal description The 01 of the N04,Covernment Lot 1,6,7, and 10, Section 16; ,also, easements for road purposes /right of ways as described under Whatcom County Auditor Fi.le Nos. 663311 and 712993, the West 20 acres of the NW!t of Section 15; also easements foi road )ur uses /right of way as described under Whatcom County Auditor's File Nos. 663311 gnd 3 Township 37 North, Range 5 (East West), W.M., Ction � 15 zr 1G, containing . 200 acres, more or less. (Attach a map if possible.) The applicant understands and agrees to the following conditions: 1. The Department of Natural Resources' consideration of the application includes a field inspection and an administrative review to determine the impact the request will have on the management of the lands involved, and to determine if the request is in accordance'with the statutes of the State. of Washington and policies of the Department of Natural Resources. 2. All reconveyances are subject to the approval of the Board of,Natural Resources. 3. If the reconveyance is approved, conveyance of title will be by quitclaim deed, which includes provision for the Department of Natural Resources to retain management of timber and mineral resources, if any.
