SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 6/16/98 RESOLUTION NO. 98 -038 TO SELL COUNTY TAX TITLE PROPERTY REQUEST NO. 98 -4 1 WHEREAS, RCW _ 84.64.270 allows the County to sell real estate acquired by tax 2 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; and, 3 WHEREAS, the Whatcom County Property Management Committee recommends the 4 - sale of the subject property; and, 5 WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said 6 unit of property and to determine whether or not a contract will be allowed, or if it will be a cash 7 price; and, 8 WHEREAS, the Whatcom County Code as well as the state law allows the County to 9 reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the 10 Council finds that it is in the best interest to reserve these; 11 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to 12 sell: 13 Parcel #400131 - 031326 -0200 having legal description of: 14 Cabana Club Condominium Unit 203 Undiv 1/48 Int in TSUC-30, 15 to the highest and best bidder, for no less than $ 320.75 ; and, 16 Parcel #400131- 031326 -0204 having legal description of: 17 Cabana Club condominium Unit 203 Undiv 1/48 Int in TSC C -40 18 to the highest and best bidder, for no less than $ 320.75 ; 19 Parcel #400106- 217174 -0000 having legal description of: 20 Hughes First Add to Blaine Frac of Lots 2 thru 6 Blk 2 21 Less RR- Hwy -All Lot 7 -Less RR 22 to the highest and best bidder, for no less than $ 490.38 23 Parcel #370328 - 461522 -0000 having legal description of. . 24 LAKEVIEW ADD TO FAIRHAVEN LOTS 19 -22 BLK 1 25 to the highest and best bidder, for no less than $ 100.00 26 Page 1 27 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall be 28 paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time 29 of sale; and, 30 BE IT FURTHER RESOLVED that said parcels shall be sold subject to restrictive 31 covenants allowing for imposition of Community Association fees, if any, as set forth in 32 Whatcom County Resolution No. 88 -37; and, 33 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil, gas, 34 gravel, minerals, ores, fossils, timber or other resources on or in said land and the right to mine 35 for and remove the same in conformity with zoning regulations in force and effect; and, 36 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to 37 'sell such property at not less than a certified price and said sale shall take place in accordance 38 with the duties as established in RCW 84.64.270. 39 APPROVED this 30 day of June , 1998. 40 41,E ATTEST: Z 43 `—Daia Brown- Davis, Council Clerk 44 APP RO ED AS TO .FORM: 45 46 Civil Deputy Prosecuting Attorney Page 2 WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON ob Imhof, Chair
