(this item): l SPONSORED BY: Consent PROPOSED BY: Planning and Development Services INTRODUCTION DATE: 11/14/00 ORDINANCE NO. 2000 -064 AMENDING THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, TITLE 20, SECTION 20.42.150 TO ALLOW PUBLIC HEALTH AND SAFETY FACILITIES AND ROAD MAINTENANCE FACILITIES WITHIN THE RURAL FORESTRY ZONING CLASSIFICATION AS A CONDITIONAL USE. WHEREAS, the Washington State Department of Transportation submitted a request for a text amendment to facilitate relocation of the WSDOT facility at Maple Falls to a more centralized and more efficient operation for the eastern part of the county, and WHEREAS, the request is similar and should be consistent with proposed text amendments in Chapter 20.40, Agriculture district, to replace the existing 20.40.151 text with the following Conditional Use text: "Public facilities for emergency related health and safety purposes, such as fire halls and Washington State Department of Transportation satellite road safety facilities ", and WHEREAS, The Deputy SEPA Official for Whatcom County issued a Determination of Non - significance on August 14, 2000; and WHEREAS, Pursuant to RCW 36.70.590, legal notice was published in the Bellingham Herald on September 15, 2000; and WHEREAS, The Planning Commission held public a hearing on the proposed amendment on September 28, 2000, and considered all testimony; and WHEREAS, The Planning Commission recommended approval of the modified text amendments on September 28, 2000; and WHEREAS, THE County Council proposed a minor amendment to the text proposed by the Planning Commission and held an additional public hearing on December 12, 2001; and WHEREAS, the County Council finds this text amendment in the best interest of the public health, safety and welfare, based on the following findings and conclusions: FINDINGS 1. The request is for a text amendment to Chapter 20.42 (Rural Forestry) of the Official Whatcom County Zoning Ordinance, to permit public uses associated with governmental buildings; public works maintenance yards or facilities such as shops and storage buildings. 2. There is, at present, no allowance made for public facilities etc. in the text of Title 20.42, (Rural Forestry) to accommodate the proposed WS DOT highway maintenance facility. 3. The WS DOT Maple Falls site is not centrally located or conducive to expansion. Page 1 4. There is a property exchange under consideration between WS DOT and Barter /Marr Logging, to allow WS DOT the opportunity to acquire larger acreage in a more central and strategic location to the rural state highways of eastern Whatcom County. 5. The text amendment to the Rural Forestry District is a prerequisite for the property exchange for the relocation of the existing maintenance facility to the larger Valley Highway site. 6. The goals and policies of GMA and the Whatcom County Comprehensive Plan call for coordination of transportation plans between the state, city and county comprehensive plans, together with making safety and mobility the primary considerations in ranking transportation improvements. 7. As the Agriculture and Rural Forest designations are both natural resource based lands under the GMA the permitted uses should parallel one another. 8. It is the goal of Whatcom County to preserve commercial timber in this zone designation and to allow only those non - forest uses that are oriented towards health and safety. 9. Proposed new wording in Chapter 20.40, Agriculture District, addresses the required text amendment that can be used also in Chapter 20.42, Rural Forest District as a Conditional Use. CONCLUSIONS 1. The amendment conforms to the Whatcom County Comprehensive Plan. 2. The amendments would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. The Official Whatcom County Zoning Ordinance are hereby amended as shown in Exhibit 1. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
