the southern 1.78 acres are zoned STC The request is to rezone the northern 3.4
acres from R5A to STC so that the entire lot will be zoned consistently.

ORDINANCE NO. 2000 -062
AMENDING THE OFFICIAL WHATCOM COUNTY ZONING MAP FROM RURAL FIVE ACRES
(R5A) TO SMALL TOWN COMMERCIAL (STC) FOR APPROXIMATELY 3.4 ACRES OF A 5.18
ACRE PARCEL LOCATED WITHIN THE SHORT TERM PLANNING AREA OF THE COLUMBIA
VALLEY /KENDALL URBAN GROWTH AREA
WHEREAS, pursuant to WCC 20.90, proposed zoning amendments shall be docketed for
consideration once per year; and
WHEREAS, the SEPA Administrator for Whatoom County issued a Determination of Non -
significance on August 2, 2000; and
WHEREAS, pursuant to RCW 36.70.590, legal notice was published in the Bellingham
Herald on July 27, 2000; and
WHEREAS, the Planning Commission held a public hearing on the proposed amendment
on August 10, 2000, and considered all testimony; and
WHEREAS, the Council held a work session on Nov. 28, , 2000 to consider this
matter; and
WHEREAS, the Council found the amendment in the best interest of the public health,
safety, and welfare; and
WHEREAS, the Council has adopted the following Findings and Conclusions:
FINDINGS
The request is to amend the Official Whatcom County Zoning map from Rural Five
Acres (R5A) to Small Town Commercial (STC) for approximately 3.4 acres of a 5.18
acre parcel in the Columbia Valley /Kendall Urban Growth Area.
2. The property is presently vacant and forested. Surrounding uses include two gas
stations with associated stores, Fire District 14's Station #2, Kendall Elementary School,
Kendall Chapel, some vacant wooded areas, scattered single family residences on large
parcels, and the Peaceful Valley, Paradise Lakes, and Campers Paradise subdivisions.
3. In March 1999, the adopted Small Town Commercial zoning map amendments resulted
in splitting the parcel with R5A and STC zoning, and Rural and Small Town
Comprehensive Plan designations.

4. In November 1999, the site was included within the Short-Term Planning Area of the
Columbia Valley /Kendall Urban Growth Area.
5. Small Town Commercial zoning is an appropriate zoning designation for an Urban
Growth Area, whereas the present R5A is not consistent with the intent of the UGA
designation.
6. The soil found on the site is SCS Prime Farmland soil and has moderate-to rapid
permeability, however the site does not meet the criteria established in WCC 20.38.020
for designation under the Agriculture Protection Overlay District (APO) and is, therefore,
not subject to the provisions of the APO.
7. The Comprehensive Plan Policies, County -wide Planning Policies, and GMA support
encouraging economic development and the provision of a sufficient amount of commercial
lands that give jobs to local people.
CONCLUSIONS
The proposal meets the goals and polices of Whatcom County regarding the provision of
sufficient commercial lands necessary for economic development and the provision jobs for
local people in Whatcom County.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that,
Section 1. The Official Whatcom County Zoning Map is hereby amended as shown in Exhibit 1.
Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this
Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof
other than the part so declared to be invalid.
