Ord. #2000- 054 Qel Ordinance or esolut;�on N er �,, (this item): #F 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 SPONSORED BY: Consent PROPOSED BY: Engineering INTRODUCTION DATE: 10/24/00 ORDINANCE NO. 2000 -054 IN THE MATTER OF ACCEPTING A PORTION OF JUDY WAY AS A PUBLIC ROAD WHEREAS, on October 10, 2000, pursuant to the procedures contained in RCW 36.8 1, the County Council adopted a resolution of intent with regard to a portion of Judy Way, between Deer Creek Drive and West Axton Road; and WHEREAS, pursuant to that resolution a public hearing on the issue of whether this roadway should be established as a county road was held on November 28, 2000; and WHEREAS, notice of the public hearing pursuant to RCW 36.81.070 was properly given and proof of such notice was properly demonstrated pursuant to RCW 36.81.080; and WHEREAS, in conjunction with the hearing the County Council received and reviewed the report of the County Road Engineer on the efficacy of the establishment of this portion of roadway as a county road; and WHEREAS, members of the public have been provided with the opportunity to provide the County Council with information and opinions relating to whether or not this portion of road should become a county road; and WHEREAS, the right of way underlying the road belongs to the County, or is deeded to Whatcom County subject to the adoption of this ordinance; and WHEREAS, in view of the information brought to its attention by staff and members of the public through the hearing process, the County Council finds that establishing the road as a county road is a public necessity and is practicable; NOW, THEREFORE, BE IT ORDAINED that the section of Judy Way located between Deer Creek Drive and West Axton Road, within Section 27, Township 39 North, Range 2 East of W. Mills, P.E. - Assistant Director 5280 Northwest Drive, Suite C Bellingham, WA 98226 MEMO TO: The Honorable Pete Kremen, County Executive, and Honorable Members of the Whatcom County Council FROM: Bruce Mills, County Road Engineer DATE: October 12, 2000 SUBJECT: REPORT OF THE COUNTY ROAD ENGINEER ON JUDY WAY In accordance with RCW 36.81, we have reviewed the portion of Judy Way, from Deer Creek Drive to West Axton Road, for inclusion into the County Road System as a public mad. Our findings am as follows: 1. Public Necessity. We find this portion of Judy Way, a private road, to be significantly impacted by public vehicular traffic, due to it being directly connected on each end to Deer Creek Drive and West Axton Road, which are both public roads. The adjacent property owners cannot afford to properly maintain the roadway, given the heavy volume of public traffic on it. Closing the roadway is not a recommended option, due to negative impacts to regular and emergency vehicle access, and the expense of constructing proper dead-end turnarounds. 2. Right -of -Way. We find that the current 16 -foot wide right -of -way needs to be widened. The adjacent property owners abutting Judy Way on the east side are willing to donate an additional 14 feet of frontage to achieve a 30 -foot wide right -of -way. Deeds were prepared by our office and have been signed, and will be accepted by the County, subject to favorable consideration by the County Council of acceptance of said road. 3. Road Width. We find that the existing 15 -foot wide paved mad needs to be widened. Whatcom County widen the paved road to 22 feet wide, identical to adjoining Deer Creek Drive, and take over the maintenance of the road. The resolution directed the County Road Engineer to provide a report upon this project. I am pleased to forward a proposed resolution for acceptance of a portion of Judy Way into the County Road System as a public road, along with the Engineer's report that recommends such acceptance. We request that the Council hold a public hearing, and by resolution accept and establish a portion of Judy Way as a County road.
