SEE AB2000 -349 FOR PLANNING COMMISSION BACKGROUND DOCUMENTATION SPONSORED BY: Consent PROPOSED BY: PDS INTRODUCTION DATE: 9/26/2000 ORDINANCE NO. 2000 -049 AMENDING THE OFFICIAL WHATCOM COUNTY COMPREHENSIVE PLAN, MAP 20, AND CLARIFYING THAT AREAS DESIGNATED RURAL FORESTRY (RF) AND COMMERCIAL FORESTRY (CF) ON MAP 20 ARE FOREST RESOURCE LANDS WHICH HAVE BEEN DESIGNATED FOR THE PURPOSES OF LONG TERM COMMERCIAL SIGNIFICANCE PURSUANT TO RCW 36.70A.170. WHEREAS, Pursuant to WCC 20.10, proposed comprehensive plan amendments shall be docketed for consideration once per year; and WHEREAS, The Deputy SEPA Official for Whatoom County issued a Determination of Non - significance on April 3, 2000; and WHEREAS, Pursuant to RCW 36.70.390, legal notice was published in the Bellingham Herald on April 27, 2000; and WHEREAS, The Planning Commission held a public hearing on the proposed amendment on May 11, 2000 and considered all testimony. WHEREAS, The Planning Commission recommended approval of the proposed map amendments on May 11, 2000; and WHEREAS, the County Council has considered the Planning Commission's Findings of Fact, Reasons for Action and Recommendation for the amendment; and WHEREAS, the Council finds the amendments in the best interest of the public health, safety, and welfare, based on the following findings and conclusions: FINDINGS OF FACT 1. Designation and conservation of forest resource lands of long -term commercial significance is required under RCW 36.70A.060. 2. The County-Wide Planning Policies require that the County develop and adopt goals, policies and regulations that protect resource land industries, and support and encourage resource-based industries. 3. The Whatcom County Comprehensive Plan, under Forest Resource Lands action item 1, states that within two years, the County shall "reaffirm the Rural Forestry and Commercial Forestry zoning designations as permanent zoning designations of forest land of long -term commercial significance". CONCLUSION The proposed amendment is consistent with the Growth Management Act, County-Wide Planning Policies and the Whatcom County Comprehensive Plan as it would "recognize the need for the protection and utilization of natural resources and resource lands" and further clarify that lands designated Rural and Commercial Forestry are to be maintained for the "conservation of productive forest lands ". NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. The Official Whatcom County Comprehensive Plan Map 20 be amended as shown on Exhibit One. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid. ADOPTED this 14 day of November , 2000.
