"IMMARY STATEMENY The request is to amend the Lynden Urban Growth .undary map in the Whalcom County Comprehensive Plan to make it more consistent with Lynden's urban growth boundary. This requires changing the zoning designation of various parcels of land from UGA designation to Ag and Rural zones. WHEREAS, anomalies exist between the Whatcom County UGA and the City of Lynden UGA boundary, and WHEREAS, the City of Lynden and Whatcom County Planners have worked together to correct these differences, and WHEREAS, a public meeting was held in Lynden on May 4, 200 to hear from affected property owners, and WHEREAS, The Deputy SEPA Official for Whatcom County issued a Determination of Non- significance on April 6, 2000; and WHEREAS, Pursuant to RCW 36.70.590, legal notice was published in the Bellingham Herald on June 29, 2000; and WHEREAS, The Planning Commission held a public hearing on the proposed amendment on July 13, 2000, and considered all testimony; and WHEREAS, The Planning Commission recommended approval of the proposed map amendments on July 13, 2000; and WHEREAS, the County Council has considered the Planning Commission's Findings of Fact, Reasons for Action and Recommendation for the amendment; and WHEREAS, the Council finds the amendments in the best interest of the public health, safety, and welfare, based on the following findings and conclusions: FINDINGS OF FACT 1. Legal notice for a public hearing was published in the Bellingham Herald on June 29, 2000. 2. A determination of non - significance was issued under the State Environmental Policy Act (SEPA) on April 6, 2000. 3. A Public Meeting was held at the Lynden City Hall, on May 4, 2000, to clarify the effects of the Whatcom County Urban Growth Area / Lynden boundary changes and to garner input from the affected property owners. 4. A public hearing was held by the Planning Commission on Thursday, July 13, 2000 and all testimony was considered. Page 1 of 2 I: \Planning \Rezones \Comp Plan 2000 \CMP2000- 00003 -Ord. 5. The request is to amend the Lynden Urban Growth Area (UGA) south boundary to bring consistency between the Whatoom County Comprehensive Plan and the City of Lynden's Comprehensive Plan. 6. Anomalies have been found between the County and City of Lynden UGA boundaries. 7. Revisions will result in consistency between the County and City of Lynden UGA boundaries. CONCLUSIONS The revisions comply with the Whatoom County Comprehensive Plan and the overall intent of the Growth Management Act. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. The Official Whatcom County Comprehensive Plan Map for the Lynden UGA is hereby amended as shown on Attachments A, B and C. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid. ADOPTED this 14 day of November , 2000.
