Aamot, Senior Planner Subject: Concurrent Review of Comprehensive Plan Amendments As you know, the Growth Management Ad requires that comprehensive plan amendments be considered only once per year, with certain exceptions. The amendments must be considered concurrently so that cumulative impacts can be assessed. This year, the County Council initiated five comprehensive plan amendments for review under Resolution No. 2000 -005. One of the comprehensive plan amendments included an associated rezone request. The Planning Commission issued "Findings of Fad, Reasons for Action, Conclusions and Recommendations" on the package of the five amendments on September 14, 2000. These amendments are: 1. Lynden Urban Growth Area Boundary (CMP 2000 - 00003). This amendment was already introduced under AB 2000 -323. 2. Unincorporated Urban Growth Area /Short Term Planning Area Policies (CMP 2000- 00004). 3. Forestry Lands Map Clarifications (CMP 2000 -00005). 4. Bellingham Urban Growth Area - Urban Residential to Light Impact Industrial Rezone (CMP 2000 - 00006). 5. Capital Facilities/Transportation Amendments (CMP 2000 - 00002). The Council can not adopt the amendments until 60 days after they were sent to the State Department of Community, Trade & Economic Development, which occurred on September 12, 2000 (RCW 36.70A.106). Additionally, the amendments have to be adopted prior to or along with the budget (WCC 20.10.040). Therefore, the request should be voted on at the Council's November 14, 2000 or November 28, 2000 meeting. 1:2 Planning Division/rezone/Comp Plan 2W0/CMP2000 Cover lever doc SPONSORED BY: Consent PROPOSED BY: PDS INTRODUCTION DATE: 9/26/2000 ORDINANCE NO. 2000 -045 AMENDING THE WHATCOM COUNTY URBAN FRINGE COMPREHENSIVE PLAN AND THE WHATCOM COUNTY ZONING MAP TO REZONE APPROXIMATELY 24 ACRES IN THE BELLINGHAM URBAN FRINGE FROM UR4 TO LII ZONING. WHEREAS, The proposed rezone site is located within the City of Bellingham Urban Growth Area on Map 15 of the Urban Fringe Subarea Plan, Dewey Valley Residential Area; and WHEREAS, The interlocal agreement with the City of Bellingham calls for a joint planning process for amendments within the Urban Fringe Subarea; and, WHEREAS, The Deputy SEPA Official for Whatcom County issued a Determination of Non - significance on April 6, 2000; and WHEREAS, Pursuant to RCW 36.70.390, legal notice was published in the Bellingham Herald on July 14, 2000; and WHEREAS, The City and County Planning Commission held a joint public hearing on the proposed amendment on July 27, 2000 and considered all testimony; and WHEREAS, The City Council held a public hearing on September 11, 2000 and recommended denial of the application; and WHEREAS, the County Council has considered the Planning Commission's Findings of Fact, Reasons for Action and Recommendation for the amendment, as well as the input from the City Planning Commission and Council; and WHEREAS, the Council finds the amendments in the best interest of the public health, safety, and welfare, based on the following findings and conclusions: FINDINGS OF FACT 1. Legal notice for a public hearing was mailed to property owners within 300 feet on July 13, posted on the site and published in the Bellingham Herald on July 14, 2000. 2. A determination of non - significance was issued under the State Environmental Policy Act (SEPA) on April 6, 2000. 3. A joint public hearing was held by the City and Planning Commissions on Thursday, July 27, 2000 and all testimony was considered. 4. The proposal is consistent with Growth Management Act, County-Wide Planning Policies, Comprehensive Plan and Urban Fringe Subarea Plan policies that call for the provision of an adequate supply of industrial land within Urban Growth Areas where transportation, labor supply, public services and utilities are available. 5. Wetlands and creeks are adequately protected by the City and County environmental Page 1 of 2 1: \PlanningU ezones \Camp Plan 2000\CMP2001 -0 006 -01RD. regulations. The proposed Light Impact Industrial zoning will not result in greater potential impacts to these resources than the current Urban Residential zoning, which could allow 96 residential units. 6. The performance standards and buffers included in the Light Impact Industrial zoning were modified last year to ensure compatibility with surrounding residential uses in the Urban Fringe Subarea. 7. The site is bordered by three high pressure gas and petroleum lines and two lines cross through the site. Increased public awareness of hazards associated with natural gas and petroleum transmission lines is a changed condition which justifies the proposed rezone. CONCLUSION The proposed amendment is consistent with the Growth Management Act, County-Wide Planning Policies, Whatcom County Comprehensive Plan, and Urban Fringe Subarea Plan and is in the public interest. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. The approximately 24 acres in the UR 4 zone be rezoned to Light Impact Industrial and the Whatcom County Urban Fringe Subarea Plan and the Whatcom County Zoning Map be amended as shown on Exhibit One. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
