RE: Amending WCC 3.08.100, Setting Requirements for Council
Approval of Contracts

In reviewing certain procedural matters, it has come to our attention that
while WCC 3.08.060 makes provision in emergency situations for bid
requirements to be waived by the county executive to expedite matters, it is
proposed that in such emergency situations the same consideration be given to
processing contracts. Currently, while bid requirements may be waived, if the
value of services or materials exceeds current levels requiring Council approval,
such contract in fact may not be signed until presented at the next Council
meeting. This may cause unnecessary delays in emergent situations.
In order to remedy this, the county's attorneys have recommended adding
language to WCC 3.08.100 which would exclude the need to bring a contract to
the County Council if such contract is needed during the declaration of
emergency issued by the county executive. In this manner then, both bid
requirements and contract approval would be handled in emergency situations
and all work and /or services could proceed in a timely manner.
I would appreciate your support of this matter to assist the administration
in providing the most timely response in cases of emergency.

RECOMMENDED MOTION: Authorize amending WCC 3.08.100 to provide an
exception to when council approval is not necessary for contracts, pursuant to
and within the scope of a declaration of emergency made by the county
executive.

AMENDING WCC 3.08.100, SETTING REQUIREMENTS FOR COUNCIL APPROVAL OF
CONTRACTS
WHEREAS, Whatcom County Code 3.08.060 makes provision that in the event of a
declaration of emergency, including those circumstances when the public interest or property of the
county would suffer material injury or damage by delay, the requirements governing competitive
bids with reference to any purchase or contract may be waived; and
WHEREAS, it is important that in such cases of emergency, the requirement to wait for
Council approval of contracts in connection with the declared emergency should also be waived; and
WHEREAS, the
language attached as Exhibit A should
replace
the current language
contained in WCC 3.08.100
in order to address this situation;
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom
County Code 3.08. 100 be amended to read, in its entirety, as set forth in the attached Exhibit A.

3.08.100 Council approval required.
Contracts for professional services exceeding $15,000, bids exceeding $35,000
and all real property leases must be submitted to the county council for approval, except
when made: a. in the exercise of an option contained in a contract or lease previously
approved by the council; or b. pursuant to, and within the scope of a declaration of
emergency made by the county executive under either Whatcom County Code 3.08.060.A
or E. The county executive, pursuant to a declaration of emergency, shall submit the
contract to the county council for informational purposes at the council's next regular or
special meeting.
