AN ORDINANCE ESTABLISHING PARKING RESTRICTIONS.
WHEREAS, Whatcom County has installed a sign to discourage
parking at a .described location for several years within Birch
Bay without the benefit of an ordinance; and,
WHEREAS, young adults are aware that the Sheriff cannot
cite them for violating the signs and have parked in the area,
using loud car stereo systems and making noise at this location
disturbing the surrounding neighbors; and,
WHEREAS, the need for an ordinance has become necessary to
allow the Sheriff's Department authority to enforce the parking
restriction and to keep them from the causing the disturbances
that has made the signs necessary in the first instance.
NOW, THEREFORE, THE WHATCOM COUNTY COUNCIL DOES ORDAIN AS
FOLLOWS:
That a new section shall be added to Whatcom County Code
10.24 which shall read as follows:
The location identified is the second class tideland in
front of and .adjacent to and abutting upon Government Lot 1,
Township 40 Range 1 East, Section 30 shall be closed from 10:00
p.m. until 6:59 a.m. daily. During the time of closure there
shall be no parking of vehicles
BE IT FURTHER ORDAINED THAT:
During the time that this area is closed anyone who is
found the area shall be ordered to disburse and if they fail to
leave shall be subject to a citation.

Signs shall be posted stating the restricting.
BE IT FURTHER ORDAINED THAT:
A violation of this ordinance shall be considered an
infraction as spelled out in WCC 10.24.130.
