Ward Nelson Introduced: August 8, 2000 Whatcom County Council No. 2000 -041 Bellingham City Council No. 2000 -31 Water District No. 10, No. 642 A JOINT RESOLUTION OF THE CITY OF BELLINGHAM, WHATCOM COUNTY, AND WATER DISTRICT 10 CREATING THE LAKE WHATCOM WATERSHED FORESTRY ADVISORY FORUM TO ACT AS A SUBCOMMITTEE OF THE LAKE WHATCOM MANAGEMENT COMMITTEE. WHEREAS,. in 1998 the Lake Whatcom Management Committee was established through interlocal agreement of the City of Bellingham, Whatcom County, and Water District No. 10; WHEREAS, by said interlocal agreement the parties thereto pledged that comments and recommendations made by the public will be used by the Management Committee; WHEREAS, said agreement also provided that the public, through citizen /other committees, would be encouraged to provide comments and recommendation throughout the year, and that additional opportunities would be provided to ensure that the public is involved in the program implementation; WHEREAS, the Lake Whatcom Watershed Forestry Forum was founded and first chaired in 1989 by then Bellingham Mayor Tim Douglas to review timber harvest plans and harvest management activities proposed in or affecting the Lake Whatcom watershed; WHEREAS, the Washington Department of Natural Resources (DNR) has been an active participant in issues addressed by the Lake Whatcom Watershed Forestry Forum and, with the support of DNR, the Forum has provided review and comment to DNR on forestry issues within the watershed since 1989, and as a result, the Forestry Forum has developed unique insight and knowledge of forestry practices within the Lake Whatcom watershed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF BELLINGHAM, WHATCOM COUNTY, AND WATER DISTRICT NO. 10 that the Lake Whatcom Watershed Forestry Advisory Forum is hereby established as outlined in Exhibit A to this resolution. Page 2 104 EXHIBIT A (LAKE WHATCOM WATERSHED FORESTRY ADVISORY FORUM) LAKE WHATCOM WATERSHED FORESTRY ADVISORY FORUM Established. Purpose. Function. Membership - Terms of Office. Organization - Meetings. Staffing. Established. There is hereby established the Lake Whatcom Watershed Forestry Advisory Forum (hereafter the "Forum "). Purpose. The Forum is created to provide, on an ongoing basis, recommendations for action and guidance to the Lake Whatcom Management Committee in the performance of its functions and duties as specified by the terms of the Interlocal Agreement as presently delineated or hereafter amended. The Forum will promote forest practices in the watershed over residential development, while working to ensure that forest management practices are conducted in consideration of preservation of water quality, and will also protect cultural, archeological, and historical sites. The Forum will pursue zoning and land use incentives to retain lands in long -term forestry through predictable and stable rules and regulations. As the Forum will integrate all existing functions of the existing Lake Whatcom Watershed Forestry Forum, said Forum is hereby dissolved. Function. The Forum will review site - specific forest practice applications submitted to the State Department of Natural Resources for recommendation to said Department. Upon request, the Management Committee may request that the Forum forward its recommendations on a specific forest practices application to the Management Committee. The Forum may request authority to review regulatory needs, policy, and regulations for forest practices. The Forum may conduct and promote other activities related to forest practices in the watershed. The Forum will develop recommendations and management strategies upon its own initiative or as directed by the Lake Whatcom Management Committee. Efforts of the Forum will be coordinated with the Lake Whatcom Management Committee. 105 Page 3 Membership - Term of Office. The Forum shall be comprised of voting and non - voting members. Amongst the voting members, the following shall be appointed by the Lake Whatcom Management Committee: 1. Three individual private forest landowners: a) two having holdings in excess of 20 acres within the Lake Whatcom watershed, and b) one with 20 acres or less in the Lake Whatcom watershed; 2. One citizen of Bellingham who resides within the Lake Whatcom watershed; 3. One citizen who resides within the unincorporated area of the Lake Whatcom watershed; 4. One member of the Whatcom County Farm Forestry Association; 5. A local representative amongst those organizations currently involved in addressing environmental concerns or issues regarding the Lake Whatcom watershed; and 6. Two representatives from the commercial timber industry. The following additional voting members shall be appointed by the organization or agency which he or she represents, one member from each: 1. Department of Natural Resources, State Lands Division; 2. Lummi /Nooksack Tribes; 3. Whatcom County Council, elected official; 4. City of Bellingham, elected official; 5. Water District #10, Commissioner; and 6. Sudden Valley Homeowners' Association (a staff member thereof). A single non - voting member from each of the following organizations or agencies shall be appointed by the agency or organization which he or she represents: 1. Whatcom County administrative staff; 2. City of Bellingham administrative staff; 3. Water District #10 management member; 4. the Department of Ecology or the Department of Fish and Wildlife; and 5. the regulatory division of the Department of Natural Resources. Voting member terms will be 2 years; provided that the terms of the members first appointed by the Management Committee shall be staggered (by initial lottery) so that half of those members first appointed will be appointed for one year. Organization - Meetings. Meetings of the Forum shall be open and accessible to the public. The Forum shall set its own meeting schedule, but it shall meet at least once each month. At every meeting, the Forum shall schedule an open session to take public comment on issues pending before the Forum. The Forum shall adopt its own rules, bylaws, and procedures for the conduct of its business. The Forum shall annually elect a chairperson and vice chairperson from among its members who shall preside at its meetings. Staffing. The Lake Whatcom Management Committee shall provide clerical staffing for the Forum in accordance with the needs of the Forum as determined by the Committee. 106 Page 4
