The Honer requests vacation of all of the alley, bisecting Block 4, of

the Town of Glacier. Alley is not open and is likely unsafe and not a
suitable access to Mt. Baker Highway. Vacation of the alley Will
facilitate better use of the site.

VACATING ALL OF THE ALLEY IN BLOCK 4, TOWN OF GLACIER
WHEREAS, on October 30, 1999, Jack Swanson, Arty., as representative of George and
Ann Savage, et al, 1200 Harris St., Ste. 307, Bellingham, WA 98225, submitted a petition for
the vacation of an alley, in the town of Glacier, accompanied by the penal sum of $682.00, to
Public Works Engineering for the vacation of the following legally described road:
All of the alley as shown in Block 4, Plat of the Town of Glacier as recorded in Vol. 6,
Pg. 2 of Plats, Section 7, Township 39 North, Range 7 East, of W.M., Whatcom County
Washington, and
WHEREAS, the County Engineer's office has reviewed the platted alley which is a Class
B -2 right of way, wherein public expenditures were not made, and part or all lies within the
platted subdivision and determined that the public would benefit from said vacation, and
WHEREAS, the petitioner has met all of the petition requirements, as set forth by
Chapter 12.20, Whatcom County Code and all other applicable laws, and
WHEREAS, the applicant has six calendar months from the date the Resolution is passed
to pay any remaining fees to the Whatcom County Council office, with checks made payable to
the Whatcom County Treasurer, prior to the vacation becoming effective, including but not
limited to the appraised value of the area sought to be vacated, and
WHEREAS, this vacation does not become effective until the fees are paid and the Final
Order and Resolution are recorded with the County Auditor, and
WHEREAS, the value of the area sought to be vacated was determined to be $2,042.00.
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
above described rightof -way, as petitioned for by George and Ann Savage, et al, be hereby
vacated.
