NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that Resolution 2000 -018 is hereby amended as outlined in Exhibit A to this resolution. APPROVED this 18'n day of AUil , 2000. ATTEST: tk Dana Brown - Davis, Clerk of the Council APPR VEDAS TO FORM: Civi rosecutor Page 1 WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON Marlene Dawson, Council Chair EXHIBIT A WHEREAS, the Whatcom County Council as the Board of Health is charged with protecting the health and safety of the citizens of Whatcom County, and; WHEREAS, the Whatcom County Council is elected to represent the concerns of the citizens of Whatcom County and charged with the broad responsibility of protecting the health and safety of the public, and looking out for the public interest, and; WHEREAS, there is now pending before the Washington Energy Facility Site Evaluation Council an application (No. 99 -1) submitted by Sumas Energy 2, Inc., for permission to construct and operate a natural gas -fired electrical energy generation plant within the City of Sumas, Whatcom County, and; WHEREAS, certain environmental, land use and natural resource concerns have been raised to the Whatcom County Council in regard to the construction and operation of said energy generation facility, and; NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the County shall petition the Washington Energy Facility Site Evaluation Council (EFSEC) to intervene as a party in the proceedings currently pending before EFSEC in the matter of Application No. 99 -1, Sumas Energy 2 Generation Facility, in order to ensure that all issues of concern to the County, to include but not limited to the following, are completely and properly addressed, to advance the best interests of Whatcom County: 1. Impacts from flood or surface water run off resulting from fill or soils displaced by the construction of said facility or its infrastructure. 2. Impacts of noise that which may interfere with the reasonable use and enjoyment of nearby real property. Modeling should include current noise sources. 3. Air: We would like to be assured that medical scientific studies are considered in evaluating health impacts to Whatcom County residents, and that the modeling includes all current sources of air emissions in the area, and Chiliwack, B.C. air quality data. 4. Impacts to area aquifers. BE IT FURTHER RESOLVED that any position or comment from the full Council will be affirmed by a majority vote of all Councilmembers and our legal counsel will be our sole spokesperson throughout the EFSEC process.
