1 WHEREAS, RCW 84.64.270 allows the County to sell real estate acquired by tax
2 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; and,
3 WHEREAS, the Whatcom County Property Management Committee recommends the
4 sale of the subject property by negotiation; and,
5 WHEREAS, per RCW 84.64.320 (3), the county legislative authority may dispose of tax
6 foreclosed property by private negotiation, without a call for bids, for not less than the principal
7 amount of the unpaid taxes when no acceptable bids were received at the attempted public
8 auction of the property, if the sale is made within six months from the date of the attempted
9 public auction; and,
to WHEREAS, the following described property was acquired through a real property tax
I1 foreclosure sale, is now, and has been the property of the County of Whatcom, State of
12 Washington since November 19, 1999; and,

WHEREAS, Resolution
95 -005 designated
the Whatcom County Treasurer as

negotiator in such sales; and,
15 WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said
16 unit of property and to determine whether or not a contract will be allowed, or if it will be a cash
17 price; and,
18 WHEREAS, the Whatcom County Code as well as the state law allows the County to
19 reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if
20 the Council finds that it is in the best interest to reserve these;
21 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to
22 sell:

32 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and
33 shall be paid in either cash, certified check, or money order to the Whatcom County Treasurer
34 at the time of sale; and,
35 BE IT FURTHER RESOLVED that said parcels shall be sold subject to restrictive
36 covenants allowing for imposition of Community Association fees, if any, as set forth in
37 Whatcom County Resolution No. 88 -37; and,
38 BE IT FURTHER RESOLVED that this sale transfers to the owners all coal, oil, gas,
39 gravel, minerals, ores, fossils, timber or other resources on or in said land and the right to mine
40 for and remove the same in conformity with zoning regulations in force and effect; and,
41 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to
42 sell such property at not less than the above minimum prices and said sales shall take place in
43 accordance with the duties as established in RCW 84.64.270.
