Birch Bay Water and Sewer District has submitted a Comprehensive Sewer
System Plan for County review. Pursuant to RCW 57.76.010(6), the County
legislative authority must approve, conditionally approve or reject a
comprehensive sewer system plan. The Planning & Development Services
Department recommends approval ofthe Birch Bay Water and Sewer District
Comprehensive Sewer System Plan, subject to several conditions.

CONDITIONALLY APPROVING BIRCH BAY WATER & SEWER DISTRICT
COMPREHENSIVE SEWER SYSTEM PLAN
WHEREAS, State law (RCW 57.16.010(6)) requires the County Council to
approve, conditionally approve, or reject comprehensive sewer system plans; and
WHEREAS, Birch Bay Water and Sewer District submitted a Comprehensive
Sewer System Plan for approval on October 28, 1999; and
WHEREAS, a determination of non - significance was issued pursuant to the State
Environmental Policy Act; and
WHEREAS, Pursuant to RCW 57.16.010(6), the Birch Bay Water and Sewer
District Comprehensive Sewer System Plan has been approved by the Whatcom County
Division of Engineering; and
WHEREAS, Pursuant to RCW 57.16.010(6), the Birch Bay Water and Sewer
District Comprehensive Sewer System Plan has been conditionally approved by the
Whatcom County Health & Human Services Department; and
WHEREAS, the County Council reviewed the Birch Bay Water and Sewer
District Comprehensive Sewer Plan for compliance with the approval criteria set forth in
RCW 57.16.010(6)) and RCW 57.02.040 and finds that the plan satisfies these criteria,
provided that conditions of approval are met;
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council
hereby approves the Birch Bay Water and Sewer District Comprehensive Sewer System
Plan dated October 1999, subject to the following conditions:
1. Approval of the portion of Birch Bay Water and Sewer District's Comprehensive
Sewer System Plan relating to Special Study Area No. 2 is withheld because it is
designated Rural on the Whatcom County Comprehensive Plan map.
2. Properties within the Urban Growth Area shall not be provided with sewer service
unless they are also within a Short Term Planning Area.
3. The next time Birch Bay Water and Sewer District's Comprehensive Sewer
System Plan is amended, the area in the Blaine Urban Growth Area, south of
California Creek and east of Blaine Rd., should be evaluated for inclusion in the
sewer service area (in consultation with the City of Blaine). Note.: Urban Growth
Area designations will be re- evaluated in 2002. Therefore, prior to formulating
future plans for sewer service areas, the Comprehensive Plan map in effect at that
time should be consulted.

STAFF REPORT
I. BACKGROUND INFORMATION
Subject: Sewer System Plan Approval
Applicant: Birch Bay Water and Sewer District
Summary of Request: County Council approval of Birch Bay Water and Sewer District
Comprehensive Sewer System Plan as required by RCW 57.16.010(6).
SEPA: The Responsible SEPA Official for Birch Bay Water and Sewer District issued a
Determination of Non - Significance on September 2, 1999.
County Division of Engineering Approval: December 10, 1999.
County Health and Human Services Approval: December 8, 1999
State Department of Ecology Approval: Not granted yet.
Discharge: Treated wastewater from the Birch Bay Water and Sewer District treatment plant is
discharged into Georgia Strait near Point Whitehom.
Existing Services (1998): 4,956 residential customer equivalents (RCE's)
County Council Timeframe: The Birch Bay Water and Sewer District Comprehensive Sewer
System Plan was submitted for approval on October 28, 1999. Pursuant to RCW 57.16.010(6),
County Council approval, conditional approval or rejection of sewer system plans is to occur
within 90 days of submission of the plan or within 30 days of a hearing (if the hearing is held
within 90 days of submission of the plan). The Council may extend the time frame up to 90 days
is there is insufficient time to adequately review the plan.
II. ANALYSIS OF THE PROPOSED AMENDMENT
The factors that are to be considered in evaluating a proposed sewer system plan are set forth in
RCW 57.16.010(6) and RCW 57.02.040(3). These factors are addressed below.-

(A) Whether the proposed action in the area under consideration is in compliance with
the development program that is outlined in the county comprehensive plan, or city
or town comprehensive plan where appropriate, and its supporting documents.
The Whatcom County Comprehensive Plan designates land covered by Birch Bay Water and
Sewer District's plan as: (1) Birch Bay Urban Growth Area, (2) Blaine Urban Growth Area, and
(3) Rural. The following zoning districts implement these three Comprehensive Plan
designations:

✓ Urban Residential Medium Density six dwellings /acre zoning
✓ Resort Commercial zoning
✓ General Commercial zoning
✓ Neighborhood Commercial zoning
Blaine Urban Growth Area Comprehensive Plan designation
✓ Urban Residemi;fTbur dwellings/acre zoning
✓ Rural one dwelling/ten acre zoning
Rural Comprehensive Plan designation
✓ Rural one dwelling /five acre zoning
✓ Rural one dwelling/ten acre zoning
Staff has reviewed the Birch Bay Water and Sewer District's Comprehensive Sewer System Plan
and finds that it is generally consistent with the Whatcom County Comprehensive Plan and
zoning, with one exception. Special Study Area No. 2 consists of 160 acres on Birch Bay - Lynden
Rd., east of Blaine Rd., that is designated Rural on the Whatcom County Comprehensive Plan.
This 160 acres is not within an Urban Growth Area.
Whatcom County Comprehensive Plan Policy 5Q -1 is to "Discourage extension of sewer lines in
areas not designated for urban growth unless there are serious public health or environmental
concerns" (p. 5 -15). Additionally, Whatcom County Comprehensive Plan Policy 2R -2, which is
even more specific, states "... No sewer shall be extended outside a Short Term Planning Area. .
" (p. 2 -20).
Staff discussed Special Study Area No. 2 with Chris Chesson of the Whatcom County Health
and Human Services Department on December 10, 1999. Mr. Chesson was not aware of septic
system failure in this area nor other environmental problems that might lead to the need for
sewer. Therefore, staff concludes that a plan to provide sewer service to Special Study Area No.
2, such as the plan outlined on figure 7.4 of Birch Bay Water and Sewer District's

Comprehensive Sewer System Plan, is inconsistent with the Whatcom County Comprehensive
Plan. However, staff also discussed this issue with Roger Brown, Manager of Birch Bay Water
and Sewer District, on December 14, 1999. Mr. Brown indicated that the District does not intend
to extend sewer service to this Rural area unless and until the County changes the land use
designation.
The County's Comprehensive Plan divides Urban Growth Areas into Short Tenn Planning Areas
and Long Term Planning Areas. Short Tenn Planning Areas me intended for urban development
in the near term, whereas Long Term Planning Areas are intended for eventual urban
development in a longer time frame. The proposed sewer plan anticipates extending sewer lines
to areas that are currently designated as Long Term Planning Areas within the Urban Growth
Area (outside of current Short Tenn Planning Areas). The sewer plan includes a "Ten Year
Sewer Capital Improvement Plan 2000 - 2009" (p. 7 -15, 7 -16) and, it is assumed, that at least
some the Long Term Planning Areas would become Short Term Planning Areas within the next
ten yews. Therefore, the fact that the sewer plan anticipates eventual extension of these lines
does not cause concern. In fact, it is necessary to plan ahead for future sewer service to all
portions of the Urban Growth Area. However, these sewer lines should not be extended until the
Short Term Planning Area designation is also extended.
Finally, it should be noted that the sewer system improvements in the proposed plan would serve
full built -out under current zoning (see Birch Bay Water and Sewer District Comprehensive
Sewer System Plan, pp. 3 -1 and 3 -4).
(B) Whether the proposed action in the area under consideration is in compliance with
the basin -wide water and/or sewage plan as approved by the State Department of
Ecology and the State Department of Health (formerly Social and Health Services).
In their approval memo of December 8, 1999, the Whatcom County Health and Human Services
Department stated that they are not aware of any such basin -wide plan that has been approved by
the State. Additionally, on December 10, 1999, staff discussed this issue with Ed Abassi of the
Department of Ecology. He indicated that he was currently reviewing the Birch Bay Water and
Sewer District Comprehensive Sewer Plan, but was not aware of any basin -wide plan approved
by the State. Therefore, staff concludes that this criterion is not applicable.
(C) Whether the proposed action is in compliance with the policies expressed in the
county plan for water and/or sewage facilities.
Whatcom County Comprehensive Plan
Whatcom County Health & Human Services Department representative Chris Chesson indicated, in a
memo of December 8, 1999, that "... I have reviewed the Sewage Treatment Goals and Policies in
Chapter 5, Utilities, of the Whatcom County Comprehensive Plan and I do not see any conflicts between
this Plan and the County Comprehensive Plan..."

Staff would note that Goal 5Q of the Whatcom County Comprehensive Plan is to "Support development
of new sewage treatment facilities, including new pipelines and extensions of existing pipelines, to areas
designated for urban -level growth." This policy implies that plans should be made to serve all parts of
the Urban Growth Area. There is a small portion of Blaine's Urban Growth Area, south of California
Creek and east of Blaine Rd., that is not included in the plans for sewer service. Staff would request
Birch Bay Water and Sewer District to consider this area, in consultation with the City of Blaine, next
time they prepare a Comprehensive Sewer System Plan.
County -Wide Planning Policies
County -Wide Planning Policy K -1 states:
As part of the comprehensive planning process, the county and the cities shall identify
appropriate land for public facilities which meets the needs of the community, such as
schools, recreation, transportation and utility corridors ...
Interlocal Agreements
Staff is not aware of any inter -local agreements involving Whatcom County that relate to sewer
service at Birch Bay.
It appears that the proposed Water System Plan is generally consistent with the County's sewage
facilities planning efforts, with the exception of Special Study Area No. 2 (as previously
mentioned), which considers extending sewer into an area planned for rural development.
Additionally, the small portion of the Urban Growth Area south of California Creek should be
considered the next time that the sewer plan is amended.
(D) The comprehensive sewer system plan shall not provide for the extension or location
of facilities that are inconsistent with the requirements of RCW 36.70AA10.
RCW 36.70A.110 contains the urban growth area provisions of the Growth Management Act
(GMA). RCW 36.70A. 110(4) indicates:
In general, cities are the units of local government most appropriate to provide urban
governmental services. In general, it is not appropriate that urban governmental services
be extended to or expanded in rural areas except in those limited circumstances shown to
be necessary to protect basic public health and safety and the environment and when such
services are financially supportable at rural densities and do not permit urban
development.
This section of the GMA raises two issues:
❑ Birch Bay Water and Sewer District plans to serve areas within Blaine's Urban Growth Area.
❑ Birch Bay Water and Sewer District plans consider providing sewer service to an area
designated Rural under the County Comprehensive Plan.

With regard the first issue, Birch Bay Water and Sewer District's proposed service within Blaine's
Urban Growth Area, Whatcom County Comprehensive Plan Policy 2Z -2 is to:
Work with Birch Bay Water and Sewer District and the City of Blaine to resolve the issue of
jurisdiction north of Lincoln Road and east of the Semiahmoo development. As a starting
premise, assume the area between Lincoln Road and Drayton Harbor to ultimately be part of
Blaine but with water and sewer service from the district (p. 2 -48).
The Birch Bay Water and Sewer District sewer plan includes three areas that are within Blaine's
Urban Growth Area:
➢ The area between Lincoln Rd. and Drayton Harbor (Special Study Area No. 1).
➢ The area between California Creek and Portal Way.
➢ The area along Semiahmoo Dr.
Staff has reviewed the City of Blaine's Comprehensive Plan's sewer service area map, which
indicates that Blaine does not anticipate serving the area between Lincoln Rd. & Drayton Harbor nor
the area between California Creek & Portal Way. However, Blaine's Comprehensive Plan does
indicate that the area along Semiahmoo Dr. would be served by City of Blaine sewer 'ln the future.
Therefore, an apparent conflict exists between the Birch Bay Water and Sewer District's plan and
the City of Blaine's plan.
However, in a letter of December 16, 1999, the Public Works Director for Blaine, Grant Stewart,
indicated the following with regard to the Semiahmoo Dr. area:
... The City of Blaine concurs with Figure 7. 1, Proposed Sewer Facilities, wherein the area
within Blaine's UGA yet outside the current city limit is within the BBW &S [Birch Bay
Water and Sewer] service area. I do not agree that the proposed piping improvements are the
best approach to providing service to this area when it develops. Through future inter -local
agreements and potential joint planning efforts, the City of Blaine and BBW &S, with input
from developers, may devise a more efficient collection system expansion scheme ...
Based upon this letter, it appears that the conflicting service areas will be served by Birch Bay Water
and Sewer District rather than by the City of Blaine. The issue of how sewer piping improvements
are to be done will have to be resolved between the District and the City, as indicated in Mr.
Stewart's letter.
The second issue raised by the GMA is sewer service within the Rural area. As previously
mentioned, the Birch Bay Water and Sewer District is located with the Birch Bay Urban Growth
Area and the Blaine Urban Growth Area, with the exception of about 160 acres that is designated
Rural along Birch Bay - Lynden Rd. (Special Study Area No. 2). The GMA, at RCW 36.70A.030(16),
indicates that sanitary sewers are specifically excluded from the definition of "rural services."
However, sewer is included in the definition of "urban services" (RCW 36.70A.030(19)). Again, the
only part of Birch Bay Water and Sewer District's Comprehensive Sewer System Plan that raises
concern is Special Study Area No. 2, which is designated Rural under the County's land use plan.

Hl. RECOMMENDATION
Based upon the above analysis, staff recommends that the County Council approve the proposed
Birch Bay Water and Sewer District's Comprehensive Sewer System Plan, subject to the
following conditions:
1. Approval of the portion of Birch Bay Water and Sewer District's Comprehensive Sewer
System Plan relating to Special Study Area No. 2 is withheld because it is designated
Rural on the Whatcom County Comprehensive Plan map.
2. Properties within the Urban Growth Area shall not be provided with sewer service unless
they are also within a Short Term Planning Area.
3. The next time Birch Bay Water and Sewer District's Comprehensive Sewer System Plan
is amended, the area in the Blaine Urban Growth Area, south of California Creek and east
of Blaine Rd., should be evaluated for inclusion in the sewer service area (in consultation

The Plan was developed in accordance with WAC 173 - 240 -050 and will be reviewed by
DOE to assure compliance with that chapter.
I have reviewed the Plan and some highlights that I noted were:
• The impacts of including areas that change zoning designation, section 3.4 Land Use,
Service Area and Zoning, page 3 -5 and section 7.11, page 7 -17.
• The Districts attempts to resolve inflow problems, pages 5 -6 and 5 -7.
• Capital improvements for 1999 which include addition of a third secondary clarifier,
modifications to the return activated sludge pumps and controls and conversion from
chlorination to Ultraviolet Disinfection.
There are some references to on -site sewage systems (OSS) in the Plan. I would suggest the
following changes to these sections.
Section 5.6 Sewer Connection Permits, page 5 -9.
Current Whatcom County Sewage Control Regulations WCC 24.05.08 require connection to
adequate public sewer, upon failure of an existing on -site sewage system (OSS), when
adequate public sewer services are available within two hundred feet of the residence or
facility. Connection to adequate public sewer is not required for new construction.
Special Study Area No.1, page 7 -17
Most of the failing OSS identified were located near the intersection of Lincoln and
Harborview Roads, not Drayton Harbor and Shintaffer Roads.
I approve the Plan subject to the incorporation of the revisions detailed above.

I received your December 14, 1999 email questions related to sewer service area coordination. I offer the
following comments on proposed service areas described in the BBW&S 1999 Comprehensive Sewer
Plant
1. The 1999 amendment to Blaine's Comprehensive Plan contains our most recent sewer service area

2. Semiahmee Drive- The City of Blaine concurs with the Figure 7. 1, Proposed Sewer Facilities, wherein
the area withinBlaine's UGA yet outside the current city limit is within the BBW&S service area. I do
not agree that the proposed piping improvements are the best approach to providing service to this area
when it develops. Throughfuture in ter -local agreements and potentialjointplanuing efforts, the City

Proposed Sewer Facilities, wherein the area within Blaine's UGA, yet outside the current city lindt, is
outside the BBW &S service mea I feel that BBW &S would most effectively serve this area. Again, I
do not agree that the proposed piping improvements are the best approach
4. South Drayton Harbor Area -The City of Blaine has requested that this area be removed from our
UGA to comply with mandates of the GrowthMmagementHearings Board. I undustand tbat
Whalcom County bas designated this area as a Special Study Area with "immediate growth" status.
As far as I know, the county intends to place this area back into the Blaine UGA. I concur that thus
area is within the BBW &S service area I understand that a ULID is forming and they will be looking
for optimum solutions to providing sewer for the least cost
