Yfipmor marl lithe, Ordinance or ffReso ti�n�/y�Nrq)�tuber (tlltc ifeln)r SPONSORED BY: Council PROPOSED BY: Council INTRODUCTION DATE: 12 /10/02 RESOLUTION NO. 2002 -063 REGARDING COUNTY COUNCIL APPOINTMENT OF AN INTERIM SHERIFF TO FILL THE UNEXPIRED TERM CAUSED BY THE ELECTION OF THE INCUMBENT TO THE STATE SENATE WHEREAS, under the provisions of the Whatcom County Home Rule Charter, Section 3.50, the office of Sheriff of the County is an elective office; and WHEREAS, under Section 3.51 of the Charter, the term of office for the person elected as Sheriff is four years; and WHEREAS, the current Sheriff, Dale Brandland, was last elected to hold the office of Sheriff in the general election held in November 1999; and WHEREAS, Sheriff Brandland has, in the general election of November 2002, been elected by the voters of the 42n' Legislative District of the State of Washington to the State Senate; and WHEREAS, Senator -elect Brandland will of necessity resign his office as Sheriff, his resignation effective upon being sworn in as State Senator in January 2003; and WHEREAS, Mr. Brandland's resignation from the office of Sheriff of Whatcom County will create a vacancy in that office; and WHEREAS, under the provisions of Section 4.50 of the Charter, the Whatcom County Council is empowered to fill by appointment the vacancy caused by the impending resignation of Mr. Brandland; and WHEREAS, the person appointed by the Council to fill the vacancy is, under the terms of Section 4.50 of the Charter, appointed to fill the office of Sheriff of Whatcom County until (his or her) successor has been elected and certified in the general election of November 2003; and WHEREAS, Section 4.50 of the Charter states that the Council shall fill such vacancy as it deems appropriate, and further states that the appointment shall be by a majority of the Council; and WHEREAS, the Council has given public notice of the impending vacancy and has solicited applications from all persons interested in being appointed to fill the vacancy; and Page 1 WHEREAS, the qualifications for persons holding an elective office of Whatcom County are set forth in Section 4.20 of the Charter; and WHEREAS, the Council has reviewed the applications that have been submitted to it by the various applicants, and has carefully considered the qualifications of those persons to fill the office of Sheriff of Whatcom County until the election and certification of a successor in the general election of November 2003; and WHEREAS, the Council finds that William Elfo meets all of the basic legal requirements to fill an elective office of Whatcom County and further finds that he is at present, by experience, ability, and in view of all other pertinent considerations the applicant most qualified to fill the impending vacancy in the office of Sheriff of Whatcom County; NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that William Elfo is appointed to the office of Sheriff of Whatcom County, with all the powers and duties attendant thereto as provided in Section 3.52 of the Charter and Chapter 36.25 of the Revised Code of Washington, effective immediately upon the resignation of Sheriff Brandland and until a successor has been elected and certified in the general election of November 2003.
