SUMAL9RYSTATEMENT.•
The Property Management Committee recommends the sale of a portion of
County-awned property to WSDOT as right -of -way for their SR 542 (ML Baker
Highway) widening project, and requests that a resolution be passed setting a
public hearing for this sale.

HEARING AND NOTICE OF HEARING ON
SALE OF A PORTION OF COUNTY OWNED PROPERTY
REQUEST NO.
WHEREAS, the following described property is now, and has been the property of the
County of Whatcom, State of Washington; and
WHEREAS, the Washington State Department of Transportation has requested that
Whatcom County sell to them a portion of said property, as herein described, as right -of -way for
their SR 542 (Mt. Baker Highway) road widening project; and
WHEREAS, the State will be adding a bridge with a pedestrian walkway; and
WHEREAS, the Whatcom County Council does deem it in the best interest of the County
and the people thereof that a portion of said property be sold; and
WHEREAS, the Whatcom County Property Management Committee recommends the sale
of a portion of said property to the Department of Transportation in the amount of $500.
NOW, THEREFORE BE IT RESOLVED that it is in the best interest of the County to sell
to the Department of Transportation:
A portion of Parcel 400627 130055 000, further described as:
All that portion of the hereinafter described PARCEL "A" lying within a tract of land beginning at
the intersection of the SR 542 line survey of SR 542, Boulder Creek Vicinity and the west line of
Government Lot 1 in Section 28, Township 40 North, Range 6 East; thence easterly along said line
survey to Highway Engineer's Station (hereinafter referred to as HES) 706 +10 P.O.T. BK= 146 +10±
P.O.T. (22' ± LT.) AHD.; thence southerly to a point opposite said HES and 150 feet southerly
therefrom; thence westerly parallel with said line survey to the west line of said Government Lot 1,
thence northerly along the west line of said Government Lot 1 to the point of beginning.

That portion of Government Lot 1, Section 28, Township 40 North, Range 6 East of W.M.,

lying with that 100 foot strip of land conveyed to the Bellingham Bay and British Columbia
Railroad Company by deed recorded Much 31, 1906 under Auditor's File No. 97092 in
Book 82 of Deeds, Page 496 in the Auditor's Office of Whatcom County, Washington.
Situate in County of Whatcom, State of Washington
The lands herein described contain an area of 9,059 square feet, more or less, the specific details
concerning all of which are to be found in that certain map of definite location now of record and
on file in the office of the Secretary of Transportation at Olympia, and bearing date of approval
March 19, 2002.
BE IT FURTHER RESOLVED by the Whatcom County Council, that a public hearing on
the matter of the sale of said property, under said terms, be held on the 26' day of November ,
2002, at 7:00 p.m., at the County Council Chambers in the Whatcom County Courthouse, Whatcom
County, Washington; and,
BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall give
notice of such hearing in the manner prescribed by law under RC W 36.34.030.
