YES /X / NO/_/(Please explain below) Budget Ilne item number(s): SUMMARY: The petitioner, Burlington Northern and Saute Fe Railway Company, requests vacation of all of Railroad Drive abutting Lot 15 of South Blaine Five Acre Tracts for the purpose of building an inspection station/appurtenance to the existing mainline. The Public will benefit from the purchase price and the increased tax' base. Due to the requirement for a crossing, no other users of this right of way are practical other than the Railroad. The Public will benefit from this action. ORIGINATOR'S RECOMMENDED ACTION. Recommend approval. COMMITTEE ACTION TAKEN: COUNCIL ACTION TAKEN.• 201-393 11127/2001: Introduced 1/2912002: Hearing continued to February 12 meeting 211212002: Approved 7 -0, Res. #2002 -008 Related File Numbers: Ordinance or Resolution Number (this item only): ZES . *Zool - o08 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 SPONSORED BY: Consent BROUGHT FORWARD BY: Public Works INTRODUCTION DATE: 11/27/01 RESOLUTION NO. 2002 -008 VACATING ALL OF RAILROAD DRIVE RIGHT -OF -WAY AS PLATTED IN SOUTH BLAINE FIVE ACRE TRACTS WHEREAS, on September 7, 2001, Burlington Northern and Santa Fe Railway Company, a Delaware corporation, in the person of Blaine Bilderback, 2500 Lou Menk Drive, Fort worth, Texas, 76131 -2830 and as represented by Pharos Corporation, Edmonds Washington, submitted a petition for the vacation of all of Railroad Drive right -of -way, accompanied by the penal sum of $682.00, to Public Works Engineering for the vacation of the following legally described road: All of that certain right of way lying parallel and abutting the Westerly right of way line of the Great Northern Railroad and the Northeasterly line of lot 15 and shown as Railroad Drive on the plat of South Blaine Five Acre Tracts, recorded in Volume 6 of Plats, Page 27, records of Whatcom County, Washington. All situate in the Southwest quarter of the Southeast quarter of Section 8, Township 40 North, Range 1 East of W.M.. WHEREAS, the County Engineers office has reviewed the subject right of way which is a Class B -2 road, wherein no public expenditures were made and part or all lies within a platted subdivision, and WHEREAS, any connection to the County Road System would require an unapproved railroad crossing which would be prohibitively expensive and the Railroad would not support. No properties will be landlocked and the Public will benefit from the construction of a commercial facility on the the site, and WHEREAS, the petitioner has met all of the petition requirements, as set forth by Chapter 12.20, Whatcom County Code and all other applicable laws, and WHEREAS, the applicant has six calendar months from the date the Resolution is passed to pay any remaining fees to the Whatcom County Council office, with checks made payable to the Whatcom County Treasurer, prior to the vacation becoming effective, including but not limited to the appraised value of the area sought to be vacated,and WHEREAS, this vacation does not become effective until the fees are paid and the Final Order and Resolution are recorded with the County Audimr,and Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 WHEREAS, the appraised value of the area sought to be vacated is $10,980.00, and NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the above - described right -of -way, as petitioned for by Burlington Northern and Santa Fe Railway Company, et al, be hereby vacated.
