Distribution Request only those who must List names to the n et ADS Facittks Management ADS Finance ADS Human Resources ADSInf Services Assessor Auditor cooperative Extension District Court E c dve Heath RECOMMENDED ACTION: Hearing Examiner jail Juvenile Parks Planning COUNCIL ACTION TAKEN: 2001 -429A 1211112001 Introduced 1115/2002: Approved 7-0, Res. #2002-003 Rela Prosecutor Public Works Sheriff Superior Court Treasuw Debbie Hayes Other Ordinance or Resoludon Number (this item): '� I SPONSORED BY: PROPOSED BY: INTRODUCTION DATE: RESOLUTION NO. 2002 -003 TO SELL COUNTY TAX TITLE PROPERTY REQUEST NO. 0808 =01 Tr astir r Treasurer 12/11/01 1 WHEREAS, RCW 36.35.270 allows the County to sell real estate acquired by tax 2 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; 3 and, 4 WHEREAS, the Whatcom County Property Management Committee recommends the 5 sale of the subject property by negotiation; and, 6 WHEREAS, per RCW 36.35.150 (2), the county legislative authority may dispose of tax 7 foreclosed property by private negotiation, without a call for bids, for not less than the principal 8 amount of the unpaid taxes when the county legislative authority determines that it is not 9 practical to build on the property due to the physical characteristics of the property or legal to restrictions on construction activities on the property; and, 11 WHEREAS, the following described property was acquired through a real property tax 12 foreclosure sale, is now, and has been the property of the County of Whatcom, State of 13 Washington since November 19, 1999; and, 14 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as 15 negotiator in such sales; and, 16 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for 17 said unit of property and to determine whether or not a contract will be allowed, or if it will be a 18 cash price; and, 19 WHEREAS, the Whatcom County Code as well as the state law allows the County to 20 reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if 21 the Council finds that it is in the best interest to reserve these; 22 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to 23 sell: 24 Parcel #380125.485248.0000 25 KEL BAY ALL LOT 61A -PTN OF LOTS 60- 62- UNPLATTED 26 TR IN SEC 25 -38 -1E WH IS TO BE KNOWN AS 27 LOT 61A KEL BAY - -NO FURTHER DESC GIVEN 28 29 For no less than the principal taxes, interest, penalty, title search and foreclosure 30 costs totaling $648.66.
