1 WHEREAS,
RCW 36.35.270
allows the County to sell real estate acquired
by tax
2 foreclosure where it
is found to be in
the best interest of Whatcom County to sell the
same;
3 and,

WHEREAS, the Whatcom County
Property
Management Committee recommends the
5
sale of the subject property by negotiation;
and,
6 WHEREAS, per RCW 36.35.150 (2), the county legislative authority may dispose of tax
7 foreclosed property by private negotiation, without a call for bids, for not less than the principal
8 amount of the unpaid taxes when the county legislative authority determines that it is not
9 practical to build on the property due to the physical characteristics of the property or legal
to restrictions on construction activities on the property; and,
11 WHEREAS, the following described property was acquired through a real property tax
12 foreclosure sale, is now, and has been the property of the County of Whatcom, State of
13 Washington since November 19, 1999; and,

WHEREAS, Resolution
95 -005 designated
the Whatcom County Treasurer as
15
negotiator in such sales; and,
16 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for
17 said unit of property and to determine whether or not a contract will be allowed, or if it will be a
18 cash price; and,
19 WHEREAS, the Whatcom County Code as well as the state law allows the County to
20 reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if
21 the Council finds that it is in the best interest to reserve these;
22 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to
23 sell:

29 For no less than the principal taxes, interest, penalty, title search and foreclosure
30 costs totaling $648.66.

31 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and
32 shall be paid in either cash, certified check, or money order to the Whatcom County Treasurer
33 at the time of sale; and,
34 BE IT FURTHER RESOLVED that said parcels shall be sold subject to restrictive
35 covenants allowing for imposition of Community Association fees, if any, as set forth in
36 Whatcom County Resolution No. 88 -37; and,
37 BE IT FURTHER RESOLVED that this sale transfers to the owners all coal, oil, gas,
38 gravel, minerals, ores, fossils, timber or other resources on or in said land and the right to mine
39 for and remove the same in conformity with zoning regulations in force and effect; and,
40 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to
41 sell such property at not less than the above minimum prices and said sales shall take place in
42 accordance with the duties as established in RCW 36.35.270.
