( ) Yes,( X ) NO Requested Date: SUMMARY STATEMENT: Chapter 10.36 pertaining to Vehicular Ferry Passes was repealed as apart of the other amendments to rise Lummi Island Ferry Rates and Policies in December of 2001. Ferry Quarterly Passes were subsequently reestablished as a part of the rate structure in February of 2002. Monsen Mary Green Eric Schlehuber Sheri Superior Court Related County Contract #: Treasurer Other Related Fite Numbers; Ordinance or Resoludoin (this item): 'J1L� Number SPONSORED BY: Public works PROPOSED BY: Public works INTRODUCTION DATE: 4/23/02 ORDINANCE NO. 2002 -028 ORDINANCE REGARDING FERRY MULTI -RIDE CARDS AND QUARTERLY PASSES WHEREAS, on December 11, 2001, Chapter 10.36, pertaining to Vehicular Ferry Passes, was repealed as a part of the other amendments to the Lummi Island Ferry Rates and Policies, and WHEREAS, on February 26, 2002, Ferry Quarterly Passes were re- established as a part of the rate structure, and WHEREAS, it is necessary to readopt Whatcom County Code provisions governing both Ferry Multi -ride Cards and Quarterly Passes. NOW, THEREFORE, BE IT ORDAINED, that Exhibit A attached hereto is hereby approved and shall be codified as Chapter 10.36 of the Whatcom County Code. A. "Card" means Multi -ride Card. B. "Pass" means Ferry Quarterly Pass. passes shall not be transferable from one vehicle to another vehicle. 10.36.040 Replacement — Application — Affidavit required. Before a duplicate or replacement pass or card shall be issued, the County public works director asp sage. destroyed pass or card: but should he find that the grounds stated in the affidavit fail to support the alleged bona fide loss, theft, or destruction of the original pass or card, or are insufficient to find (1) probable cause to believe that the pass or card was in fact lost, or (2) was in all probability stolen, or (3) was in fact destroyed, then he shall deny the application and shall not issue the requested duplicate pass or card. In the event the application is denied, the County public works director shall make written findings setting forth the reasons why he has denied the application. 10.36.060 Reolacement — Appeal procedure. 10.36.070 Violation — Penalty.
