C(N) Requested Date: MOTION (for final action): COUNCIL ACTION TAKEN 2002-181 4/23/2002: Introduced 5O /2002: Adopted 6 -0, Nelson absent, Ord. #2002-027 Related File Numbers: Ordinance or Resolution Number (this item only): 02D# 2002 - 02.7 SPONSORED BY: Consent PROPOSED BY: McShane INTRODUCTION DATE: April 23, 2002 ORDINANCE # 2002 -027 AMENDING WHATCOM COUNTY CODE 11.16.030 TO SET A SIX MILES PER HOUR SPEED LIMIT FOR BOATS WITHIN SOUTH BAY OF LAKE WHATCOM WHEREAS, only a small portion of South Bay in Lake Whatcom is a distance greater than 300 feet from the shoreline and therefore a boat speed limit of six miles per hour already applies to most of South Bay; and WHEREAS, a public boat ramp and a private boat ramp are located within South Bay; and WHEREAS, private property and docks are being damaged by wakes generated by boats traveling at high speeds within South Bay; and WHEREAS, erosion of the shoreline and the disturbance of sediment within shallow near shore waters by boat generated waves and boat engines contributes to turbidity and the release of phosphorus and organic material may lead to lower lake oxygen levels; NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom County Code Chapter 11. 16.030 is hereby amended as indicated in the attached Exhibit A. Speed Limits. No vessel shall exceed the following speeds, except as provided in WCC 11.36: 1. Within 100 feet of a swimmer, six miles per hour; 2. Within 150 from the shore on every lake except Lake Whatcom where the distance shall be 300 feet (except when necessary for a safe take off as defined in Section 11.20.010C), six miles per hour; 3. Within 100 feet of any vessel not propelled by a motor, six miles per hour; 4. One -half hour after sunset to one -half hour before sunrise, eight miles per hour; 5. During daylight hours in unrestricted areas, 40 miles per hour; 6. Within 300 feet of any public boat launch, six miles per hour; 7 Within South Bay Lake Whatcom south of a line approximately as defined as extending from 48 °40'48 "N 122 018149 "W to 48 °40'43 "N, 122 018'36" shall be designated as a "no- wake" zone.
