WHEREAS, current statute requires that all tort liability claims be filed with the local
governing body; and
WHEREAS, Whatcom County claims are currently filed with the legislative branch of
county government though the Clerk of the Council; and
WHEREAS, with the recent passage of EHB 1530, the county is now required to
formally designate an individual to receive such claims; and
WHEREAS, the Whatcom County Prosecutor's Office has requested that they County
Council appoint the Clerk of the Council as the county's agent to receive all tort liability
claims served upon Whatcom County.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom
County Code 2.02.055 is hereby amended as follows:
