Amendment will allow the acceptance of subdivision applications that will create two parcels from a lot already containing me permitted residences. RECOMMENDED MOTION (for final action): COUNCIL ACTION TAKEN 2002 -151 3/1212002_ introduced 3/26/2002: Amended and adopted 4 -3, Fleetwood, Roy, Brenner opposed, Ord. #2002-016 Related File Numbers: Ordinance or Resolution Number (this item only): AB2001 -377 cRD x'2002 -a(o SPONSORED BY: Consent PROPOSED BY: McShane INTRODUCTION DATE: March 18, 2002 ORDINANCE # 2002 -016 AMENDING THE INTERIM MORATORIUM ON THE ACCEPTANCE OF NEW APPLICATIONS FOR SUBDIVISIONS OF LAND INTO PARCELS SMALLER THAN FIVE ACRES WITHIN THE LAKE WHATCOM WATERSHED WHEREAS, the Whatcom County Council implemented a subdivision moratorium within the Lake Whatcom Watershed in order to develop best management practices for stormwater management for subdivisions, roads and single family residences and to address impacts of both existing and future development; and WHEREAS, it has been brought to the Council's attention that subdividing lots to separate existing residences built on the same lot can not be done under the current subdivision moratorium on properties within the Lake Whatcom watershed; and WHEREAS, the intent of the interim moratorium is, in part, to prevent the vesting of new lots less than 5 -acres in size and the associated development on said lots until the County develops appropriate policy and ordinances that will adequately protect Lake Whatcom; and WHEREAS, subdividing parcels to create lots smaller than 5 -acres in order to separate preexisting permitted residences will not undermine the intent of the interim moratorium; NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Ordinance 2001 -066, the interim moratorium on the acceptance of new applications for subdivisions or short plats of land into parcels smaller than 5 -acres in the Lake Whatcom Watershed, is hereby amended so that subdivisions creating lots smaller than 5 -acres will be accepted under all of the following conditions: 1) two previously permitted residences are located on the lot to be subdivided, 2) the subdivision will separate the two residences on lots that conform with the underlying zoning, and 3) the accessory dwelling must have been permitted and constructed prior to the enactment of the subdivision moratorium.
