(YIN N Requested Date: The proposed amendment is necessary to allow mortoized vessel access to Wiser Lake from October 15 to March l of any given year. This access will allow the Washington State Department of Fish and Wildlife and the Pilchuck Valley Wildlife Researchers to collect samples, including diseased swans, from the waters of Wiser Lake to conduct research on the negative environmental impacts of lead poisoning upon the state's wildlife and water fowl. RECOMMENDED MOTION (for final action): COUNCIL ACTION TAKEN: 2101 -901 1/1512002: introduced 11202002: Adopted 7 -0, Ord. #2002 -003 Related File Numbers: Ordinance or io or Resolution Number (this item only): 1..1GU •" 2002- - J Amend 11.32, Wish Gke Ordinance Sponsored by: Counrilinaci Proposed by: Prosecutor Introduction date: � ORDINANCE NO. 21Ofn2 -nn y AMENDING THE EXCEPTIONS TO SPECIAL USE RESTRICTIONS APPLIED TO CERTAIN LAKES WITHIN WHATCOM COUNTY WHEREAS, Whatcom County Code 11.32 imposes restrictions on the use of certain lakes within Whatcom County, including a prohibition on the use of motorized vessels on the waters of Wiser Lake from October 15th to March 1st; and WHEREAS, Whatcom County Code 11.32.090 provides an exemption from these restrictions only for activities related to emergency operations necessary to save life or property; and WHEREAS, for the past several years the Washington State Department of Fish and Wildlife has been engaged in ongoing studies to investigate and stem negative environmental impacts from lead poisoning upon the state's wildlife and water fowl; and WHEREAS, the research studies involve the collection of samples, including diseased swans, from the waters of Wiser Lake during the period of time when motorized vessels are excluded from use upon the lake, pursuant to Whatcom County Code 11.32.070D; and WHEREAS, the Pilchuck Valley Wildlife researchers have been collecting samples, on behalf of the Department of Fish and Wildlife; and WHEREAS, the ability to collect samples has been hampered by the restrictions against the use of motorized vessels on Wiser Lake. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom County Code 11.32 is hereby amended as indicated below: 11.32.090 Exceptions. No restrictions contained in this chapter shall be deemed to apply to persons or vessels engaged in emergency operations necessary to save life or property or in ADOPTED this 29 day of --January--, 2001.
