ListspeePc names to the right ADS Facilities Management ADS Finance Brad Bennett, Margarine Caldwell ADS Human Resources ADSInfo Services Assessor Auditor Cooperative Extension District Court Executive Dewey Better, Francine Kmiald Health Hearing Examiner Jail COUNCIL ACTION TAKEN. 2003 -347 10121/2003 Inttl 11/5/5/ Adopted 03: Adopted 6 -1, Brenner opposed Ord. 112003 -053 Related County Contract #: Juvenile Parks Planning Prosecutor Public Works Sherri Superior Court Treasurer Other Related File Numbers: Ordinance or Resol (this item): 'on N her • 053 INTRODUCED BY: Consent PROPOSED BY: Countv Executive DATE: October 21, 2003 ORDINANCE NO. 2003 -053 AN ORDINANCE AUTHORIZING THE LEVY OF TAXES FOR COUNTY AND STATE PURPOSES IN WHATCOM COUNTY, WASHINGTON, FOR THE YEAR OF 2004 PURSUANT TO HOME RULE CHARTER SECTION 6.10 WHEREAS, pursuant to Home Rule Charter Section 6.10 the County Executive is required to submit for Council consideration a budget and proposed tax and revenue ordinances necessary to raise sufficient revenues to balance the budget; and, WHEREAS, the County Council has reviewed that proposed annual budget, including all sources of revenues and anticipated expenditures; and, WHEREAS, the annual budget has detailed listings of various revenues including property taxes; and, WHEREAS, the flood fee will lapse at the end of 2003 and this assessment will not be renewed for 2004, and WHEREAS, The flood fee assessment will be partially replaced by a general fund property tax levy and a property tax levy of the County Wide Flood Control Zone District. and WHEREAS, the County Council has held a public hearing concerning the annual budget, the property tax rates, and revenues included therein. NOW, THEREFORE, BE IT ORDAINED AND ESTABLISHED by the Whatcom County Council: (A) The property taxes for Whatcom County are hereby levied and are to be charged to the assessment and tax rolls of Whatcom County; and, (B) Property taxes are levied in 2003 for collection in 2004; and, Page 1 (C) The amounts collected through the County general levy shall be limited to the amount of 2003 taxes, increased for the addition of new construction and improvements to property and any increase in the value of state assessed property. A property tax increase, in addition to the amount resulting from the addition of new construction and improvements to property and any increase in the value of state- assessed property, is hereby authorized for the 2004 levy in the amount of $ 1,400,000, which is a percentage increase of 7.64% from the previous year; and, (D) Because the state of Washington is unable to provide the figures and documentation necessary to establish fixed levy rates, as these figures do become available from the state, levies shall be fixed per "Exhibit A" which shall be prepared by the County Assessor, and attached and incorporated herein by reference. BE IT FURTHER ORDAINED, that the taxes to be levied against parcels of property within the Diking Districts, Drainage Districts, and Drainage Improvement Districts are to be credited to the individual maintenance funds for the year 2004, and the amounts to be apportioned to the original assessments for construction in said districts are as follows per "Exhibit B" attached hereto and incorporated herein by reference. BE IT FURTHER ORDAINED, that if the Washington State Legislature changes any laws affecting levies contained herein, and the Prosecuting Attorney's Office concurs, the Whatcom County administration will change such levies accordingly.
